HOUSE BILL NO. 5014

September 19, 2023, Introduced by Reps. Thompson, Johnsen, Bezotte, Wozniak, St. Germaine and Beson and referred to the Committee on Criminal Justice.

A bill to amend 1965 PA 203, entitled

"Michigan commission on law enforcement standards act,"

by amending the title and section 9e (MCL 28.609e), the title as amended by 1998 PA 237 and section 9e as added by 2018 PA 552.

the people of the state of michigan enact:

TITLE

An act to provide for the creation of create the Michigan commission on law enforcement standards; to prescribe its membership, powers, and duties; to prescribe the reporting responsibilities of certain state and local agencies; to provide for additional costs in criminal cases; to provide for the training and licensing of law enforcement officers; to provide for the establishment of the law enforcement officers training fund; and to provide for disbursement of allocations from the law enforcement officers training fund to local agencies of government participating in a police training program.

Sec. 9e. (1) Beginning January 1, 2020, an individual seeking to become licensed under section 9, 9b, 9c, or 9d shall complete active violence response training that emphasizes coordinated tactical response to rapidly developing incidents in which intentional physical injury or death to a specific population occurs through the use of conventional or unconventional weapons and tactics.

(2) The commission shall promulgate rules establishing the minimum standards for the active violence response training required under subsection (1).

(3) Beginning January 1, 2020, an individual who is licensed under section 9, 9b, 9c, or 9d shall complete the active violence response training described under subsection (1).

(4) Beginning January 1, 2025, the commission shall require an individual to have either of the following before granting a license under section 9, 9b, 9c, or 9d:

(a) The rank of blue belt or higher in Brazilian jiu-jitsu from a certified instructor.

(b) A certificate of equivalent training.

(5) An individual who is licensed under section 9, 9b, 9c, or 9d on January 1, 2025 shall, no later than January 1, 2027, obtain either of the following:

(a) The rank of blue belt or higher in Brazilian jiu-jitsu from a certified instructor.

(b) A certificate of equivalent training.

(6) Beginning January 1, 2027, a law enforcement officer shall complete not less than 4 hours of grappling training each year. The commission may approve a grappling training course provided by a certified instructor as meeting the requirements of this subsection.

(7) As used in this section:

(a) "Certificate of equivalent training" means a document signed by a certified instructor that signifies that the named individual has received significant unarmed combat grappling training, including, but not limited to, any of the following:

(i) Two years of high school varsity wrestling experience or 5 years of other wrestling experience.

(ii) Two or more mixed martial arts fights as a licensed professional mixed martial arts fighter.

(iii) The rank of brown belt in Judo.

(b) "Certified instructor" means an individual who has 1 or more of the following:

(i) The rank of black belt in Brazilian jiu-jitsu.

(ii) Certification as an instructor from the International Brazilian Jiu-Jitsu Federation or an equivalent organization, as determined by the commission.

(iii) Not less than 20 years of experience as a grappling instructor.

(c) "Grappling training" means training in hand-to-hand combat that is used at close range to gain a physical advantage over an opponent.
