          Committee on Corporations, Authorities and Commissions

        AN ACT to amend the public service law and the general business law,  in
          relation  to  requiring the display of a notice of responsibilities to
          protect underground facilities

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Section  119-b  of  the  public service law is amended by
     2  adding a new subdivision 9 to read as follows:
     3    9. Any entity which leases excavation equipment to  the  public  shall
     4  provide  a  notice  to lessees of such excavation equipment that informs
     5  such lessees about their responsibilities under  state  law  to  protect
     6  underground facilities and the existence, operation, programs, and tele-
     7  phone number of the one-call notification system.
     8    §  2.  Subdivision  2  of  section  761 of the general business law is
     9  amended by adding a new paragraph h to read as follows:
    10    h. Provide any entity which leases excavation equipment to the  public
    11  with  the  telephone  number  of the system and a sample or model notice
    12  informing lessees of  excavation  equipment  of  the  system  and  their
    13  responsibilities  relating  to the protection of underground facilities;
    14  cooperate with entities that lease  excavation  equipment  to  encourage
    15  their  participation  in  the  system  to ensure that when lessees lease
    16  excavation equipment, such lessees receive information about the  system
    17  and about their obligation to protect underground facilities.
    18    § 3. This act shall take effect on the one hundred eightieth day after
    19  it shall have become a law.
