AN ACT

Amending the act of July 28, 1953 (P.L.723, No.230), entitled,

2

as amended, "An act relating to counties of the second class

3

and second class A; amending, revising, consolidating and

4

changing the laws relating thereto," further providing for

5

enumeration of elected officers.

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

Section 1.  Section 401 of the act of July 28, 1953 (P.L.723,

9

No.230), known as the Second Class County Code, is amended by

10

adding a subsection to read:

Section 401.  Enumeration of Elected Officers.--* * *

12

(d)  The office of jury commissioner may be abolished by

13

referendum at the option of each county whenever electors equal

14

to at least five per centum of the highest vote cast for any

15

office in the county at the last preceding general election

16

shall file a petition with the county board of elections or the

17

governing body of the county adopts, by a majority vote, a

18

resolution to place such a question on the ballot and a copy of

19

the resolution is filed with the county board of elections for a

referendum on the question of abolishing the office of jury

2

commissioner. The referendum shall not take place in any year in

3

which the office of jury commissioner is on the ballot.

Proceedings under this subsection shall be in accordance with

5

the provisions of the act of June 3, 1937 (P.L.1333, No.320),

6

known as the "Pennsylvania Election Code." Upon approval of the

7

referendum the office of jury commissioner shall expire at the

8

completion of the current jury commissioners' terms of office.

Section 2.  This act shall take effect in 60 days.
