CHAPTER 596 An Act to classify certain falling water generation facilities as RPS eligible sources. [S 495] Approved April 5, 2024

 

Be it enacted by the General Assembly of Virginia:

1. §1. That notwithstanding any contrary provision of law, for the purposes of §56-585.5 of the Code of Virginia, any falling water generation facility located in the Commonwealth and commencing commercial operations prior to July 1, 2024, shall be considered a renewable energy portfolio standard (RPS) eligible source. For the purposes of this act, "falling water" has the same meaning as provided for that term in § 56-585.5 of the Code of Virginia.
