AN ACT
making nuclear emergency management fund assessments; Appropriating monies.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Appropriations; nuclear emergency management fund; uses
Pursuant to sections 26‑306.01 and 26‑306.02, Arizona Revised Statutes, the sum of $2,549,792 in fiscal year 2019‑2020 and the sum of $2,576,291 in fiscal year 2020‑2021 are appropriated from the nuclear emergency management fund to the following agencies and for the following purposes:
1. The sum of $719,000 and 5.5 FTE positions in fiscal year 2019‑2020 and the sum of $749,000 and 5.5 FTE positions in fiscal year 2020‑2021 to the division of emergency management of the department of emergency and military affairs to use as provided in section 26‑306.02, Arizona Revised Statutes.
2. The sum of $789,663 and 5.5 FTE positions in fiscal year 2019‑2020 and the sum of $789,663 and 5.5 FTE positions in fiscal year 2020‑2021 to the department of health services for programs relating to off‑site nuclear emergency response plans.
3. The sum of $301,376 and 2.88 FTE positions in fiscal year 2019‑2020 and the sum of $280,512 and 2.88 FTE positions in fiscal year 2020‑2021 to the Arizona department of agriculture for programs relating to off‑site nuclear emergency response plans.
4. The sum of $669,753 in fiscal year 2019‑2020 and the sum of $687,116 in fiscal year 2020‑2021 to the division of emergency management of the department of emergency and military affairs to disburse to departments and agencies of Maricopa county that are assigned responsibilities under the off‑site nuclear emergency response plan.
5. The sum of $70,000 in fiscal year 2019‑2020 and the sum of $70,000 in fiscal year 2020‑2021 to the division of emergency management of the department of emergency and military affairs to disburse to departments and agencies of the town of Buckeye that are assigned responsibilities under the off‑site nuclear emergency response plan.
Sec. 2. Assessments; purpose
Pursuant to section 26-306.01, Arizona Revised Statutes, the sum of $2,549,792 in fiscal year 2019‑2020 and the sum of $2,576,291 in fiscal year 2020‑2021, plus any applicable interest, are assessed against each consortium of public service corporations and municipal corporations engaged in constructing or operating a commercial nuclear generating station in this state.
Sec. 3. Emergency
This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
