AN ACT

 

amending title 9, chapter 4, article 6.4, arizona revised statutes, by adding section 9-469; amending title 11, chapter 2, article 9, arizona revised statutes, by adding section 11-324; relating to building permits.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 9, chapter 4, article 6.4, Arizona Revised Statutes, is amended by adding section 9-469, to read:

START_STATUTE9-469.  Building permits; green buildings; definition

A.  municipalities shall adopt standards for issuing building permits in an expedited manner for the new construction of green buildings or the remodeling of an existing building in which the remodeled building will be classified as a green building.

B.  if AN EXPEDITED BUILDING PERMIT IS ISSUED FOR THE new CONSTRUCTION of a green building or the remodel OF A building to meet the classification of a GREEN BUILDING AND SUBSEQUENTLY THE BUILDING FAILS TO MEET THE CLASSIFICATION OF A GREEN BUILDING, THE MUNICIPALITY MAY retroactively SUSPEND THE BUILDING PERMIT FOR THE same PERIOD OF TIME IT WOULD HAVE TAKEN FOR THE PERMIT TO BE ISSUED IN A NONEXPEDITED MANNER.

C.  Section 41‑194.01 does not apply to THIS SECTION.

D.  FOR THE PURPOSES OF THIS SECTION, "GREEN BUILDING" MEANS A building that is environmentally responsible and resource-efficient throughout the building's life-cycle from siting, designing, constructing, operating, maintaining, renovating and deconstructing and that complies with the United States environmental protection agency's requirements for a green building. Sec. 2.  Title 11, chapter 2, article 9, Arizona Revised Statutes, is amended by adding section 11-324, to read:

START_STATUTE11-324.  Building permits; green buildings; definition

A.  the board of supervisors shall adopt standards for issuing building permits in an expedited manner for the new construction of green buildings or the remodeling of an existing building in which the remodeled building will be classified as a green building.
