SENATE BILL 1141

 

 

 

AN ACT

 

amending title 28, chapter 3, article 5, Arizona Revised Statutes, by adding section 28‑696; relating to driving violations.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Heading change

The article heading of title 28, chapter 3, article 5, Arizona Revised Statutes, is changed from "RECKLESS AND AGGRESSIVE DRIVING" to "DRIVING VIOLATIONS".

Sec. 2.  Title 28, chapter 3, article 5, Arizona Revised Statutes, is amended by adding section 28-696, to read:

START_STATUTE28-696.  Distracted driving

A person MAY not drive a motor vehicle while distracted.  A person violates this section if both of the following occur while driving a motor vehicle:

1.  The person engages in any activity that is not related to the actual driving of the motor vehicle in a manner that visibly interferes with safely driving the motor vehicle.

2.  The person drives a motor vehicle in a manner that is an immediate hazard to a person or property or the person does not exercise reasonable control of a motor vehicle as necessary to avoid colliding with any object, person, vehicle or other conveyance on, entering or adjacent to the highway.
