SENATE BILL 1291

 

 

 

AN ACT

 

Amending title 32, chapter 13, article 4, Arizona Revised Statutes, by adding section 32‑1473; amending title 36, chapter 4, article 1, Arizona Revised Statutes, by adding section 36-420; relating to emergency aid.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 32, chapter 13, article 4, Arizona Revised Statutes, is amended by adding section 32-1473, to read:

START_STATUTE32-1473.  Emergency care or assistance to persons who have fallen; nonliability; exception

A person who in good faith renders emergency care or emergency assistance to a person who has fallen is not liable for any civil damages as the result of any act or omission by the person rendering the emergency care or emergency assistance to the person who has fallen, unless the person acted with gross negligence while rendering the emergency care or emergency assistance, if The person rendering aid acted under any of the following circumstances:

1.  At the specific direction of an emergency dispatch operator.

2.  To prevent further imminent and serious injury to the person who has fallen.

3.  When the fallen person appeared to not be injured and stated that the fallen person was not injured and requested to be assisted to a sitting or standing position or other position. END_STATUTE

Sec. 2.  Title 36, chapter 4, article 1, Arizona Revised Statutes, is amended by adding section 36-420, to read:

START_STATUTE36-420.  Health care institutions; fall prevention; fall recovery; training program

Each skilled nursing facility and assisted living facility shall develop and administer a training program for all facility staff regarding fall prevention and fall recovery.  The training program shall include initial training and continued competency in fall prevention and fall recovery.  A facility may use information and training materials from the department's Arizona falls prevention coalition in developing the facility's training program.END_STATUTE
