AN ACT

 

amending title 9, chapter 4, article 8, arizona revised statutes, by adding section 9-500.48; amending title 11, chapter 2, article 4, arizona revised statutes, by adding section 11-269.27; relating to liability claims.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 9, chapter 4, article 8, Arizona Revised Statutes, is amended by adding section 9-500.48, to read:

START_STATUTE9-500.48.  Liability claims; notice

A.  If a city or town is aware of a potential claim or cause of action involving the city or town and the potential claimant has not filed a notice of claim pursuant to section 12-821.01 at least ninety days before the notice of claim time frame expire under section 12-821.01, the city or town must notify all potential claimants of the obligation to file a notice of claim as prescribed in section 12-821.01.

B.  If the city or town fails to notify all potential claimants at least ninety days before the notice of claim time frame expires pursuant to section 12-821.01, the claimant has two years after the date the potential claim or cause of action accrues to file a claim.  END_STATUTE

Sec. 2.  Title 11, chapter 2, article 4, Arizona Revised Statutes, is amended by adding section 11-269.27, to read:

START_STATUTE11-269.27.  Liability claims; notice

A.  If a county is aware of a potential claim or cause of action involving the county and the potential claimant has not filed a notice of claim pursuant to section 12-821.01 at least ninety days before the notice of claim time frame expires under section 12-821.01, the county must notify all potential claimants of the obligation to file a notice of claim as prescribed in section 12-821.01.

B.  If the county fails to notify all potential claimants at least ninety days before the notice of claim time frame expires pursuant to section 12-821.01, the claimant has two years after the date the potential claim or cause of action accrues to file a claim. END_STATUTE

Sec. 3.  Applicability

Sections 9-500.48 and 11-269.27, Arizona Revised Statutes, as added by this act, apply to cases in which the cause of action accrues from and after the effective date of this act.
