An act to amend Section 2851 of add Section 5888 to the Health and Safety Code, relating to public mental health.

Existing law establishes the Mental Health Student Services Act as a mental health partnership competitive grant program for the purpose of establishing mental health partnerships between a county’s mental health or behavioral health departments and school districts, charter schools, and the county office of education within the county. Existing law requires the Mental Health Services Oversight and Accountability Commission to establish criteria for the grant program and requires that applicants for the program submit a plan that, among other things, describes the need for mental health services for children and youth, including campus-based mental health services.

This bill would require a school district, charter school, or county office of education that receives a grant under the program to submit an annual data report to the Legislature indicating how the funds were used, including, among other things, the amount of grant funds received and the number of mental health service workers that were compensated with those funds. The bill would require the data report to be submitted to the Legislature on or before January 15 of each year, and would require the data report to cover the grant funds received by the school district, charter school, or county office of education for the prior year.

Existing law authorizes the organization of a pest abatement district by a petition describing the exterior boundaries of the proposed district and the nature of the pest or pests to be controlled or abated. Existing law requires members of the pest abatement district board to serve without compensation, except for their necessary traveling and other expenses incurred in performance of their official duties.

This bill would make a technical, nonsubstantive change to those provisions.

The people of the State of California do enact as follows:

SECTION 1.

 Section 5888 is added to the Welfare and Institutions Code, to read:

5888.

 (a) A school district, charter school, or county office of education that receives a grant pursuant to Section 5886 shall submit an annual data report to the Legislature indicating how the grant funds were used, including all of the following:

(1) The amount of funds received pursuant to the grant program.

(2) The number of mental health service workers that were compensated with funds from the grant program.

(3) The amount of funds that were used to create infrastructure or policies assisting mental health services.

(b) The data report shall be submitted to the Legislature on or before January 15 of each year, and shall cover the grant funds received by the school district, charter school, or county office of education for the prior year.

(c) The data report shall be submitted to the Legislature in compliance with Section 9795 of the Government Code.

SECTION 1.Section 2851 of the Health and Safety Code is amended to read:

2851.

The members of the district board shall hold office at the pleasure of the board of supervisors. The members shall serve without compensation, but shall be allowed their necessary traveling and other expenses incurred in performance of their official duties. In lieu of expenses, the district board may, by resolution, provide for the allowance and payment to each member of the board of a sum not exceeding one hundred dollars ($100) as expenses incurred in attending each business meeting of the board. Reimbursement for these expenses is subject to Sections 53232.2 and 53232.3 of the Government Code.
