An act to add Chapter 4.5 (commencing with Section 6320) to Division 7 of Title 1 of the Government Code, relating to state government.

Existing law, the Unruh Civil Rights Act, specifies that all persons within the jurisdiction of the state are free and equal, and no matter their sex, race, color, religion, ancestry, national origin, disability, medical condition, genetic information, marital status, sexual orientation, citizenship, primary language, or immigration status are entitled to the full and equal accommodations, advantages, facilities, privileges, or services in all business establishments of every kind.

This bill would establish in state government the Commission on the State of Hate. The bill would provide for the appointment of 10 members, appointed by the Governor, the Speaker of the Assembly, and the Senate Committee on Rules, as provided. The bill would require the commission to advise the Legislature, the Governor, and state agencies on, among other things, policy recommendations to promote intersocial education designed to foster mutual respect and understanding among California’s diverse population. The bill would require the commission to report to the Legislature annually, as provided.

The people of the State of California do enact as follows:

SECTION 1.

Chapter 4.5 (commencing with Section 6320) is added to Division 7 of Title 1 of the Government Code, to read:

CHAPTER 4.5. Commission on the State of Hate

6320.

(a) There is hereby established in state government the Commission on the State of Hate. The commission shall be composed of ten members, as follows:

(1) Four members appointed by the Governor.

(2) Three members appointed by the Speaker of the Assembly.

(3) Three members appointed by the Senate Committee on Rules.

(b) Appointments to the commission shall be considered among individuals who possess professional experience, expertise, or specialized knowledge in combating hate, intolerance, and discrimination on the basis of sex, color, race, religion, ancestry, national origin, disability, medical condition, marital status, sexual orientation, citizenship, primary language, immigration status, or genetic information.

(d) Members of the Legislature shall serve on the commission as ex officio members without vote and shall participate in the activities of the commission to the extent that their participation is not inconsistent with their legislative duties.

(e) Members of the commission may select representatives to attend commission activities if they are unable to attend.

(f) Nonlegislative members of the commission shall receive reimbursement for per diem and expenses while engaged in commission activities, upon appropriation by the Legislature. Legislative members of the commission shall receive no compensation.

(g) The commission shall have the following goals:

(1) Advise the Legislature, the Governor, and state agencies on policy recommendations to do all of the following:

(A) Promote intersocial education designed to foster mutual respect and understanding among California’s diverse population.

(B) Suggest and prescribe recommended training for state officials and staff to recognize and address dangerous acts of hate and intolerance.

(2) Notwithstanding Section 10231.5, report to the Legislature annually through the Joint Committee on Rules on the work of the commission beginning on July 1, 2022.

(h) Any report submitted to the Legislature pursuant to this chapter shall be submitted in compliance with Section 9795.
