HOUSE BILL NO. 18

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO DIRECTING THE PROCEEDS FROM CHARITABLE VIDEO LOTTERY MACHINES TO AND CHANGING THE ELIGIBILITY FOR THE DELAWARE VETERANS TRUST FUND.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 4819A, Title 29 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 4819A. Charitable video lottery machines use and restrictions.

(c) (1) Proceeds returned to the State. Amounts remaining after After making all payments to players under subsection (b) of this section, there shall be returned an eligible charitable gaming organization must return to the State 40% If. from the amounts remaining, either of the following:

a. One percent to the Division of Substance Abuse and Mental Health of the Department of Health and Social Services for funding programs for the treatment, education education, and assistance of compulsive gamblers and their families.

b. Three percent from veteran’s organizations that are charitable gaming organizations to the Delaware Veterans Trust Fund under § 8721 of this title.

Section 2. Amend § 8721, Title 29 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 8721. Delaware Commission of Veterans' Affairs — Duties and responsibilities.

(f) The Commission shall establish and administer the "Delaware Veterans Trust Fund" which will provide financial assistance or grants to honorably discharged veterans with a minimum discharge of general discharge under honorable conditions to cover costs associated with medical and dental needs; medical transportation; homelessness support; home repairs and safety modifications; household utilities; and educational or retraining programs.

Section 3. Section 1 of this Act takes effect on July 1, 2019.

Section 4. Section 2 of this Act takes effect on January 1, 2020.

SYNOPSIS

This Act makes all veterans with a minimum discharge of general discharge under honorable conditions eligible for assistance from the Delaware Veterans Trust Fund, effective January 1, 2020. This Act also directs 3% of the proceeds returned to the State from the proceeds of charitable video lottery machines operated by veteran’s organizations to the Delaware Veterans Trust Fund, effective July 1, 2019, so that there are sufficient funds to assist the expanded number of individuals who will be eligible for assistance.

This Act also makes technical corrections to improve clarity of existing law and to conform it to the standards of the Delaware Legislative Drafting Manual.
