A bill to be entitled
2An act relating to profiting from jury service;
3creating s. 40.245, F.S.; prohibiting a juror from
4requesting or accepting any monetary benefit or
5compensation related to his or her role as a juror
6until a certain time has elapsed; prohibiting a person
7or organization from offering or providing any
8monetary benefit or compensation for obtaining
9information related to a juror's role in a trial until
10a certain time has elapsed; providing penalties;
11providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:

15     Section 1.  Section 40.245, Florida Statutes, is created to
16read:
17     40.245  Profiting from jury service.-
18     (1)  A juror in a civil or criminal trial may not, before
19or during the trial or within 270 days after the jury is
20discharged, request, accept, agree to accept, or discuss with
21any person the receiving or accepting of any monetary benefit or
22compensation or licensing fees of the juror's likeness or
23photograph in consideration for supplying information related to
24his or her role as a juror in the trial.
25     (2)  A person or organization may not, before or during a
26civil or criminal trial or within 270 days after the jury is
27discharged, offer or discuss with any juror the promise or
28payment of any monetary benefit or compensation or any licensing
29fees of the juror's likeness or photograph in consideration for
30obtaining information related to the juror's role in the trial.
31     (3)  A person who violates this section commits a felony of
32the third degree, punishable as provided in s. 775.082 or by a
33fine of $10,000 for each violation, or both.
34     Section 2.  This act shall take effect July 1, 2012.
