2A memorial to the Congress of the United States,
3urging Congress to discontinue its practice of
4imposing federal mandates and legislation upon the
5states which exceed the scope of its constitutionally
6delegated powers under the Tenth Amendment to the
7Constitution of the United States and to repeal
8existing compulsory federal legislation that directs
9the states to comply or requires the states to pass
10specific legislation in order not to lose federal
11funding.

13     WHEREAS, the people of the State of Florida assert their
14residual and inviolable sovereignty under the Tenth Amendment to
15the Constitution of the United States over all powers not
16otherwise enumerated and granted to the Federal Government by
17that Constitution, and
18     WHEREAS, the people of the State of Florida also refuse to
19comply with mandates issued by any branch of the Federal
20Government which are beyond the scope of such constitutionally
21delegated powers and demand that the Federal Government cease
22and desist from issuing mandates that are beyond the scope of
23such powers, and
24     WHEREAS, the people of the State of Florida further refuse
25to recognize or comply with any compulsory federal legislation
26that directs the state to comply or requires the state to pass
27specific legislation in order not to lose federal funding, and
28     WHEREAS, the sovereignty of the State of Florida is
29threatened by federal mandates and legislation that exceed the
30scope of power delegated to the Federal Government under the
31Tenth Amendment to the Constitution of the United States, and
32     WHEREAS, the imposition of excessive federal enactments
33diminishes the rights and abilities of the people of the State
34of Florida to govern themselves as a free and independent state,
35NOW, THEREFORE,

37Be It Resolved by the Legislature of the State of Florida:

39     That the Congress of the United States is urged to
40discontinue its current practice of imposing federal mandates
41and legislation upon the states which exceed the scope of its
42constitutionally delegated powers under the Tenth Amendment to
43Constitution of the United States.
44     BE IT FURTHER RESOLVED that the Congress is also urged to
45repeal all existing compulsory federal legislation that directs
46the states to comply or requires the states to pass specific
47legislation in order not to lose federal funding.
48     BE IT FURTHER RESOLVED that copies of this memorial be
49dispatched to the President of the United States, to the
50President of the United States Senate, to the Speaker of the
51United States House of Representatives, and to each member of
52the Florida delegation to the United States Congress.
