A bill to be entitled
2An act relating to state lotteries; creating s.
324.132, F.S.; providing for a special instant scratch-
4off lottery game titled Ticket for the Cure; providing
5for revenues to be used for the purpose of funding
6breast cancer research and services for certain breast
7cancer victims; providing restrictions for the use of
8funds; defining the terms "net revenue" and
9"research"; authorizing the Department of the Lottery
10to adopt rules; amending s. 24.121, F.S.; providing
11for revenues to be equitably apportioned to certain
12state universities to be used for the purpose of
13funding breast cancer research and services for
14certain breast cancer victims; providing an effective
15date.

17Be It Enacted by the Legislature of the State of Florida:

19     Section 1.  Section 24.132, Florida Statutes, is created to
20read:
21     24.132  Ticket for the Cure.-
22     (1)  The department shall offer a special instant scratch-
23off lottery game with the title "Ticket for the Cure." The game
24shall commence on January 1, 2013, and shall be discontinued on
25December 31, 2018. During the time that tickets are sold for the
26Ticket for the Cure game, the department may not unreasonably
27diminish the efforts devoted to marketing any other instant
28scratch-off lottery game.
29     (2)(a)  The net revenue from the Ticket for the Cure
30scratch-off game shall be allocated pursuant to s. 24.121(5)(f)
31to be used for the purpose of funding breast cancer research and
32services for low-income, uninsured breast cancer victims. The
33funds may not be used for institutional, organizational, or
34community-based overhead costs, indirect costs, or levies.
35     (b)  As used in this section, the term:
36     1.  "Net revenue" means the total amount for which tickets
37have been sold less the sum of the amount paid out in prizes and
38the actual administrative expenses of the department solely
39related to the Ticket for the Cure game.
40     2.  "Research" includes, but is not limited to,
41expenditures to develop and advance the understanding,
42techniques, and modalities effective in the detection,
43prevention, screening, and treatment of breast cancer, including
44clinical trials.
45     (3)  The department may adopt rules to implement this
46section.
47     Section 2.  Paragraph (b) of subsection (5) of section
4824.121, Florida Statutes, is amended, present paragraph (f) of
49that subsection is redesignated as paragraph (g), and a new
50paragraph (f) is added to that subsection, to read:
51     24.121  Allocation of revenues and expenditure of funds for
52public education.-

54     (b)  Except as provided in paragraphs (c), (d), and (e),
55and (f), the Legislature shall equitably apportion moneys in the
56trust fund among public schools, community colleges, and
57universities.
58     (f)  The net revenues received pursuant to s. 24.132 shall
59be equitably apportioned to state universities that have medical
60research facilities or that are associated with medical research
61facilities. The moneys shall be used for the purpose of funding
62breast cancer research and services for low-income, uninsured
63breast cancer victims pursuant to s. 24.132.
64     (g)(f)  Each school district shall, on a quarterly basis,
65make available to the public and distribute, in an easy to
66understand format, the expenditures of lottery funds allocated
67to the school district.
68     Section 3.  This act shall take effect July 1, 2012.
