A bill to be entitled
2An act relating to the collection and disposal of
3household pharmaceuticals; creating s. 403.745, F.S.;
4requiring the Department of Environmental Protection
5to establish a grant program to reimburse local law
6enforcement agencies for the expenses associated with
7the collection and disposal of household
8pharmaceuticals; providing eligibility requirements;
9creating s. 938.16, F.S.; requiring that the court
10impose an additional surcharge for specified offenses;
11providing for the proceeds of the surcharge to be
12deposited into the Household Pharmaceuticals
13Collection and Disposal Trust Fund; providing for the
14clerk of the court to retain a service charge;
15providing an effective date.

17Be It Enacted by the Legislature of the State of Florida:

19     Section 1.  Section 403.745, Florida Statutes, is created
20to read:
21     403.745  Household pharmaceuticals collection and disposal
22grant program.-The department shall establish a grant program to
23reimburse local law enforcement agencies for the expenses
24associated with the collection and disposal of household
25pharmaceuticals. To be eligible for a grant, a law enforcement
26agency must conduct the collection and disposal of household
27pharmaceuticals in a manner consistent with applicable rules of
28the department and applicable state and federal requirements.
29     Section 2.  Section 938.16, Florida Statutes, is created to
30read:
31     938.16  Additional cost to fund the household
32pharmaceuticals collection and disposal grant program.-In
33addition to any sanction imposed for a violation of s. 893.13,
34s. 893.135, or s. 893.1351, the court shall impose a surcharge
35of $21. Payment of the surcharge shall be a condition of
36probation, community control, or any other court-ordered
37supervision. Twenty dollars of the surcharge shall be deposited
38into the Household Pharmaceuticals Collection and Disposal Trust
39Fund established in s. 403.7451. The clerk of the court shall
40retain $1 of each surcharge that the clerk of the court collects
41as a service charge of the clerk's office.
42     Section 3.  This act shall take effect July 1, 2012.
