A bill to be entitled
2An act relating to community residential homes; amending
3s. 419.001, F.S., relating to site selection of community
4residential homes; revising the definition of the term
5"community residential home"; defining the term "sober
6house transitional living home"; requiring supervision of
7the residents of such a home; requiring that a sober house
8transitional living home comply with standards of
9occupancy set by the local government; providing
10restrictions on the provision of onsite substance abuse
11treatment services; limiting applicability; providing an
12effective date.

14Be It Enacted by the Legislature of the State of Florida:
15
16     Section 1.  Paragraph (a) of subsection (1) of section
17419.001, Florida Statutes, is amended, present paragraph (f) of
18that subsection is redesignated as paragraph (g), and a new
19paragraph (f) is added to that subsection, to read:
20     419.001  Site selection of community residential homes.-
21     (1)  For the purposes of this section, the term:
22     (a)  "Community residential home" means a dwelling unit
23licensed to serve residents who are clients of the Department of
24Elderly Affairs, the Agency for Persons with Disabilities, the
25Department of Juvenile Justice, or the Department of Children
26and Family Services or licensed by the Agency for Health Care
27Administration which provides a living environment for 7 to 14
28unrelated residents who operate as the functional equivalent of
29a family, including such supervision and care by supportive
30staff as may be necessary to meet the physical, emotional, and
31social needs of the residents, or a dwelling unit that operates
32as a sober house transitional living home.
33     (f)  "Sober house transitional living home" means a
34community residential home that provides a peer-supported and
35managed alcohol-free and drug-free living environment. In order
36to promote a residence as a sober house transitional living
37home, it must be supervised by a house manager who ensures that
38a sober living environment is maintained and who offers
39structure and peer support. A sober house transitional living
40home must adhere to local municipal or county standards of
41occupancy. Substance abuse treatment may not be provided onsite
42unless provided by a licensed service provider as defined in s.
43397.311(17). The limitations of this definition do not apply to
44a sober living facility that is affiliated with, managed by, or
45operated by a licensed service provider as defined in s.
46397.311(17).
47     Section 2.  This act shall take effect July 1, 2011.
