    1                        A bill to be entitled                      
    2         An act relating to nonemergency medical transportation
    3         services; amending s. 316.87, F.S.; authorizing, at
    4         the request of an eligible plan, a licensed basic or
    5         advanced life support ambulance service to provide
    6         nonemergency medical transportation in permitted
    7         ambulances in any county, notwithstanding any
    8         ordinance relating to certificates of public
    9         convenience and necessity or a specified provision
   10         relating to licensure; providing an effective date.
   11          
   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Section 316.87, Florida Statutes, is amended to
   15  read:
   16         316.87 Nonemergency medical transportation services.—To
   17  ensure the availability of nonemergency medical transportation
   18  services throughout the state, a provider licensed by the county
   19  or operating under a permit issued by the county may not be
   20  required to use a vehicle that is larger than needed to
   21  transport the number of persons being transported or that is
   22  inconsistent with the medical condition of the individuals
   23  receiving the nonemergency medical transportation services. At
   24  the request of an eligible plan defined in s. 409.962, a
   25  licensed basic or advanced life support ambulance service may
   26  provide nonemergency medical transportation in permitted
   27  ambulances in any county, notwithstanding any ordinance relating
   28  to certificates of public convenience and necessity or s.
   29  401.25. This section does not apply to the procurement,
   30  contracting, or provision of paratransit transportation
   31  services, directly or indirectly, by a county or an authority,
   32  pursuant to the Americans with Disabilities Act of 1990, as
   33  amended.
   34         Section 2. This act shall take effect July 1, 2019.
