1                        A bill to be entitled 
2         An act relating to enterprise zones; amending s. 
3         290.0055, F.S.; authorizing certain governing bodies 
4         to apply to the Office of Tourism, Trade, and Economic 
5         Development to amend the boundary of an enterprise 
6         zone that includes a rural area of critical economic 
7         concern; providing a limitation; authorizing the 
8         office to approve the amendment application subject to 
9         certain requirements; requiring that the office 
10         establish the effective date of certain enterprise 
11         zones; creating s. 290.00726, F.S.; authorizing Martin 
12         County to apply to the Office of Tourism, Trade, and 
13         Economic Development for designation of an enterprise 
14         zone; providing application requirements; authorizing 
15         the office to designate an enterprise zone in Martin 
16         County; providing responsibilities of the office; 
17         providing an effective date.

19  Be It Enacted by the Legislature of the State of Florida: 
20 
21         Section 1. Paragraph (d) is added to subsection (6) of 
22  section 290.0055, Florida Statutes, to read: 
23         290.0055 Local nominating procedure.— 
24         (6) 
25         (d)1. The governing body of a jurisdiction which nominated 
26  the application for an enterprise zone that includes a portion 
27  of the state designated as a rural area of critical economic 
28  concern pursuant to s. 288.0656(7) may apply to the Office of 
29  Tourism, Trade, and Economic Development to expand the boundary 
30  of the enterprise zone by not more than 3 square miles. Such 
31  application must be submitted by December 31, 2011. 
32         2. Notwithstanding the area limitations specified in 
33  subsection (4), the Office of Tourism, Trade, and Economic 
34  Development may approve the request for a boundary amendment if 
35  the area continues to satisfy the remaining requirements of this 
36  section. 
37         3. The Office of Tourism, Trade, and Economic Development 
38  shall establish the initial effective date of an enterprise zone 
39  designated under this paragraph. 
40         Section 2. Section 290.00726, Florida Statutes, is created 
41  to read: 
42         290.00726Enterprise zone designation for Martin County. 
43  Martin County may apply to the Office of Tourism, Trade, and 
44  Economic Development for designation of one enterprise zone for 
45  an area within Martin County, which zone shall encompass an area 
46  up to 10 square miles consisting of land within the primary 
47  urban services boundary and focusing on Indiantown, but 
48  excluding property owned by Florida Power and Light to the west, 
49  two areas to the north designated as estate residential, and the 
50  county-owned Timer Powers Recreational Area. Within the 
51  designated enterprise zone, Martin County shall exempt 
52  residential condominiums from benefiting from state enterprise 
53  zone incentives, unless prohibited by law. The application must 
54  be submitted by December 31, 2010, and must comply with the 
55  requirements of s. 290.0055. Notwithstanding s. 290.0065 
56  limiting the total number of enterprise zones designated and the 
57  number of enterprise zones within a population category, the 
58  Office of Tourism, Trade, and Economic Development may designate 
59  one enterprise zone under this section. The Office of Tourism, 
60  Trade, and Economic Development shall establish the initial 
61  effective date of the enterprise zone designated pursuant to 
62  this section. 
63         Section 3. This act shall take effect January 1, 2011.
