    1                        A bill to be entitled                      
    2         An act relating to specialty license plates; amending
    3         s. 320.08058, F.S.; directing the Department of
    4         Highway Safety and Motor Vehicles to develop a Florida
    5         Swims license plate; providing for distribution and
    6         use of fees collected from the sale of such plates;
    7         providing a contingent effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Subsection (85) is added to section 320.08058,
   12  Florida Statutes, to read:
   13         320.08058 Specialty license plates.—
   14         (85) FLORIDA SWIMS LICENSE PLATES.—
   15         (a)The department shall develop a Florida Swims license
   16  plate as provided in this section and s. 320.08053. The plate
   17  must bear the colors and design approved by the department. The
   18  word “Florida” must appear at the top of the plate, and the
   19  words “Swim for Life” must appear at the bottom of the plate.
   20         (b)The department shall retain all annual use fees from
   21  the sale of the plate until all startup costs for developing and
   22  issuing the plate have been recovered. Thereafter, the annual
   23  use fees from the sale of the plate shall be distributed to
   24  Swimming Pool Education and Safety Foundation, Inc., doing
   25  business as Florida Swims, a nonprofit organization under s.
   26  501(c)(3) of the Internal Revenue Code, which may use up to 15
   27  percent of such fees for administrative costs and marketing of
   28  the plate. The balance of the fees shall be used by Swimming
   29  Pool Education and Safety Foundation, Inc., doing business as
   30  Florida Swims, to promote swimming pool and water safety and to
   31  provide grants and scholarships for childhood swimming lessons
   32  in Florida.
   33         Section 2. This act shall take effect July 1, 2020, but
   34  only if SB __ or similar legislation takes effect, if such
   35  legislation is adopted in the same legislative session or an
   36  extension thereof and becomes a law.
