    1                        A bill to be entitled                      
    2         An act relating to the Statewide Emergency Shelter
    3         Task Force; establishing the task force adjunct to the
    4         Department of Management Services; specifying the task
    5         force’s purpose; providing for the membership of the
    6         task force; providing requirements and restrictions
    7         for members of the task force; authorizing
    8         reimbursement for per diem and travel expenses;
    9         requiring the task force to report recommendations to
   10         the Governor and the Legislature by a specified date;
   11         providing for expiration; providing an effective date.
   12          
   13  Be It Enacted by the Legislature of the State of Florida:
   14  
   15         Section 1. (1) The Statewide Emergency Shelter Task Force,
   16  a task force as defined in s. 20.03(8), Florida Statutes, is
   17  established adjunct to the Department of Management Services.
   18  The purpose of the task force is to make recommendations to the
   19  Governor and the Legislature regarding the establishment and
   20  operation of state-designated emergency shelters. The
   21  recommendations must include, but are not limited to, a review
   22  of the local, state, and federal activities organized, planned,
   23  and executed at emergency shelters during the past 10 years,
   24  with a specific focus on the following:
   25         (a) A review of all resources, including financial
   26  resources, provided in the designation and operation of
   27  emergency shelters, and whether the process used to designate
   28  and operate emergency shelters was effective in the preparation,
   29  operation, and cleanup of such shelters; and
   30         (b) A quantification of any expenditures for the operation
   31  and cleanup of emergency shelters, including repair expenditures
   32  for any damage caused by the emergency shelter’s occupation
   33  which have been less than the actual costs of completing such
   34  tasks; the governmental entity that was responsible for paying
   35  such uncovered costs; and whether the deficit was due to a lack
   36  of resources or a local, state, or federal policy.
   37         (2) The task force is composed of the following members:
   38         (a) One member representing state facilities, who shall
   39  serve as chair, appointed by the secretary of the Department of
   40  Management Services.
   41         (b) One public school superintendent, appointed by the
   42  Commissioner of Education.
   43         (c) One member representing Florida College System
   44  institutions and state universities, appointed by the Chancellor
   45  of the State University System.
   46         (d) One member representing charter schools, appointed by
   47  the Commissioner of Education.
   48         (e) One member representing independent postsecondary
   49  institutions, appointed by the Commissioner of Education.
   50         (f) One member representing emergency response agencies,
   51  appointed by the director of the Division of Emergency
   52  Management.
   53         (g) One member representing facilities constructed with the
   54  assistance of state funds, appointed by the Governor.
   55         (3) Members shall serve at the pleasure of their appointing
   56  authority. Any vacancy must be filled in the same manner as the
   57  original appointment. A member of the Legislature or a
   58  registered legislative or executive branch lobbyist may not be
   59  appointed to the task force. In accordance with s. 20.052(4)(d),
   60  Florida Statutes, members shall serve without compensation but
   61  are entitled to reimbursement of travel and per diem expenses as
   62  provided in s. 112.061, Florida Statutes, in the performance of
   63  their duties and responsibilities under this section.
   64         (4) The task force shall report its recommendations
   65  regarding the establishment and operation of state-designated
   66  emergency shelters to the Governor, the President of the Senate,
   67  and the Speaker of the House of Representatives by December 15,
   68  2020.
   69         (5) This section expires May 15, 2021.
   70         Section 2. This act shall take effect July 1, 2020.
