    1                        A bill to be entitled                      
    2         An act relating to fees; amending s. 381.986, F.S.;
    3         authorizing the Department of Health to require the
    4         payment of specified fees relating to the registration
    5         of and the operating licenses, facility permits, and
    6         vehicle permits for medical marijuana treatment
    7         centers (MMTCs); authorizing the department to refuse
    8         to issue or renew an operating license or facility
    9         permit of an MMTC that has failed to pay an
   10         application or renewal fee; authorizing the department
   11         to charge a specified fee for issuing and annually
   12         renewing an MMTC employee identification card;
   13         providing a contingent effective date.
   14          
   15  Be It Enacted by the Legislature of the State of Florida:
   16  
   17         Section 1. Present paragraph (k) of subsection (8) of
   18  section 381.986, Florida Statutes, as amended by SB ____, is
   19  redesignated as paragraph (l), a new paragraph (k) is added to
   20  that subsection, and paragraph (e) is added to subsection (9) of
   21  that section, to read:
   22         381.986 Medical use of marijuana.—
   23         (8) MEDICAL MARIJUANA TREATMENT CENTERS.—
   24         (k) The department may require the payment of the following
   25  fees:
   26         1.For MMTC registration, an initial registration fee not
   27  to exceed $1,000 and a biennial renewal fee not to exceed $500.
   28         2.For a cultivation license, an initial application fee
   29  not to exceed $1,000, a licensure fee not to exceed $50,000, and
   30  a biennial renewal fee not to exceed $50,000.
   31         3. For a processing license, an initial application fee not
   32  to exceed $1,000, a licensure fee not to exceed $50,000, and a
   33  biennial renewal fee not to exceed $50,000.
   34         4. For a retail license, an initial application fee not to
   35  exceed $1,000, a licensure fee not to exceed $10,000, and a
   36  biennial renewal fee not to exceed $10,000.
   37         5. For a transportation license, an initial application fee
   38  not to exceed $1,000, a licensure fee not to exceed $10,000, and
   39  a biennial renewal fee not to exceed $10,000.
   40         6. For each vehicle permit, an initial application fee of
   41  $500 per vehicle.
   42         7. For each facility permit, an initial permitting fee not
   43  to exceed $5,000 and a biennial renewal fee not to exceed
   44  $5,000.

   46  The department may refuse to issue or renew a cultivation,
   47  processing, retail, or transportation license or facility permit
   48  for an MMTC that has failed to pay an application or renewal fee
   49  for the operating license or permit.
   50         (9) MEDICAL MARIJUANA TREATMENT CENTER PERSONNEL;
   51  REGISTRATION; EMPLOYEE IDENTIFICATION CARDS.—
   52         (e) The department may charge a reasonable fee when issuing
   53  and upon annually renewing an MMTC employee identification card,
   54  not to exceed $75.
   55         Section 2. This act shall take effect on the same date that
   56  SB ____ or similar legislation takes effect, if such legislation
   57  is adopted in the same legislative session or an extension
   58  thereof and becomes a law.
