    1                        A bill to be entitled                      
    2         An act relating to construction materials mining
    3         activities; amending s. 552.30, F.S.; requiring that
    4         blasting reports be submitted to the Chief Financial
    5         Officer and the State Fire Marshal; requiring the
    6         Division of State Fire Marshal to make such reports
    7         publicly available on its webpage; providing report
    8         requirements; providing legislative findings and
    9         intent; providing an effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Subsections (4) and (5) are added to section
   14  552.30, Florida Statutes, to read:
   15         552.30 Construction materials mining activities.—
   16         (4)All blasting reports must be submitted to the Chief
   17  Financial Officer and the State Fire Marshal. The division shall
   18  make the reports publicly available on its webpage. The reports
   19  must contain the elements described in chapter 69A-2, Florida
   20  Administrative Code, including frequency level and peak particle
   21  velocity.
   22         (5)The Legislature finds that the 1978 United States
   23  Bureau of Mines study is not indicative or authoritative of any
   24  concrete evidence for future studies and findings with regard to
   25  areas of low depth to water table and that there has never been
   26  a specific study on the structure response and damage produced
   27  by ground vibration from surface mine blasting in areas of low
   28  depth to water table. The Legislature intends that the Chief
   29  Financial Officer administer duties to protect homes from
   30  damages caused by blasting at a low depth to water table.
   31         Section 2. This act shall take effect July 1, 2020.
