    2         An act relating to the statewide heart attack
    3         registry; creating s. 395.30385, F.S.; requiring the
    4         Agency for Health Care Administration to contract with
    5         a private entity to establish and maintain a statewide
    6         heart attack registry, subject to a specific
    7         appropriation; requiring hospitals to provide certain
    8         information to the statewide heart attack registry;
    9         requiring the contracted entity to use a nationally
   10         recognized platform to collect data; requiring the
   11         contracted entity to provide reports on heart attack
   12         performance measures to the agency; providing
   13         hospitals immunity from liability under certain
   14         circumstances; providing an effective date.

   16  Be It Enacted by the Legislature of the State of Florida:
   17  
   18         Section 1. Section 395.30385, Florida Statutes, is created
   19  to read:
   20         395.30385Statewide heart attack registry.—
   21         (1)Subject to specific appropriation by the Legislature,
   22  the agency shall contract with a private entity to establish and
   23  maintain a statewide heart attack registry to ensure that the
   24  heart attack performance measures required to be submitted under
   25  subsection (2) are maintained and available for use to improve
   26  or modify the heart attack care system, ensure compliance with
   27  standards and nationally recognized guidelines, and monitor
   28  heart attack patient outcomes.
   29         (2)Each hospital regulated by this chapter shall regularly
   30  report information consistent with nationally recognized heart
   31  attack performance measures to the statewide heart attack
   32  registry.
   33         (3)The agency shall require the contracted private entity
   34  to use a nationally recognized platform to collect data from
   35  each hospital on the heart attack performance measures required
   36  in subsection (2). The contracted private entity shall provide
   37  regular reports on the data collected to the agency.
   38         (4)A liability of any kind or character for damages or
   39  other relief may not arise or be enforced against any hospital
   40  by reason of having provided such information to the statewide
   41  heart attack registry.
   42         Section 2. This act shall take effect October 1, 2020.
