    1                          Senate Resolution                        
    2         A resolution encouraging the Governor to negotiate an
    3         agreement with the Seminole Tribe of Florida, Inc.,
    4         which authorizes on-reservation sales of tax-exempt
    5         cigarettes to nontribal members, and to present the
    6         proposed agreement to the Legislature for its
    7         consideration under s. 210.1801(6), Florida Statutes.

    9         WHEREAS, in 1979, the Legislature enacted s. 210.05(5),
   10  Florida Statutes, authorizing on-reservation sales of tax-exempt
   11  cigarettes to nontribal members by the Seminole Tribe of
   12  Florida, Inc., and
   13         WHEREAS, in 2009, the Legislature enacted s. 210.1801,
   14  Florida Statutes, which repealed the authority granted to the
   15  Seminole Tribe of Florida, Inc., in 1979, and
   16         WHEREAS, s. 210.1801(6), Florida Statutes, contemplates the
   17  resumption of on-reservation sales of tax-exempt cigarettes to
   18  nontribal members by the Seminole Tribe of Florida, Inc., under
   19  an agreement with the State of Florida, NOW, THEREFORE,

   21  Be It Resolved by the Senate of the State of Florida:
   22  
   23         That the Governor is encouraged to negotiate an agreement
   24  with the Seminole Tribe of Florida, Inc., which authorizes on
   25  reservation sales of tax-exempt cigarettes to nontribal members,
   26  and to present the proposed agreement to the Legislature for its
   27  consideration under s. 210.1801(6), Florida Statutes, at the
   28  next regular session of the Legislature.
