    1                        A bill to be entitled                      
    2         An act relating to inmates and higher education;
    3         amending s. 1011.80, F.S.; deleting a provision
    4         prohibiting certain state funds from being used for
    5         the education of state or federal inmates; amending s.
    6         1011.81, F.S.; deleting a provision prohibiting the
    7         use of certain state funds for the education of state
    8         or federal inmates; amending s. 1011.84, F.S.;
    9         deleting a provision prohibiting the instruction of
   10         state inmates from being included in specified
   11         enrollment for certain education funding; providing an
   12         effective date.

   14  Be It Enacted by the Legislature of the State of Florida:
   15  
   16         Section 1. Subsection (7) of section 1011.80, Florida
   17  Statutes, is amended to read:
   18         1011.80 Funds for operation of workforce education
   19  programs.—
   20         (7)(a) A school district or Florida College System
   21  institution that receives workforce education funds must use the
   22  money to benefit the workforce education programs it provides.
   23  The money may be used for equipment upgrades, program
   24  expansions, or any other use that would result in workforce
   25  education program improvement. The district school board or
   26  Florida College System institution board of trustees may not
   27  withhold any portion of the performance funding for indirect
   28  costs.
   29         (b)State funds provided for the operation of postsecondary
   30  workforce programs may not be expended for the education of
   31  state or federal inmates.
   32         Section 2. Subsection (4) of section 1011.81, Florida
   33  Statutes, is amended to read:
   34         1011.81 Florida College System Program Fund.—
   35         (4)State funds provided for the Florida College System
   36  Program Fund may not be expended for the education of state or
   37  federal inmates.
   38         Section 3. Paragraph (e) of subsection (1) of section
   39  1011.84, Florida Statutes, is amended to read:
   40         1011.84 Procedure for determining state financial support
   41  and annual apportionment of state funds to each Florida College
   42  System institution district.—The procedure for determining state
   43  financial support and the annual apportionment to each Florida
   44  College System institution district authorized to operate a
   45  Florida College System institution under the provisions of s.
   46  1001.61 shall be as follows:
   47         (1) DETERMINING THE AMOUNT TO BE INCLUDED IN THE FLORIDA
   48  COLLEGE SYSTEM PROGRAM FUND FOR THE CURRENT OPERATING PROGRAM.—
   49         (e) All state inmate education provided by Florida College
   50  System institutions shall be reported by program, FTE
   51  expenditure, and revenue source. These enrollments,
   52  expenditures, and revenues shall be reported and projected
   53  separately. Instruction of state inmates shall not be included
   54  in the full-time equivalent student enrollment for funding
   55  through the Florida College System Program Fund.
   56         Section 4. This act shall take effect July 1, 2018.
