RESOLUTION
Creating
the Senate Retail Dealers of Distilled Spirits Study Committee; and for other
purposes.
WHEREAS,
the State of Georgia has imposed a limitation on the number of retail dealer
licenses for the sale of distilled spirits to prevent a person and his or her
immediate family members from possessing or having a beneficial interest in more
than two such licenses; and
WHEREAS,
this limitation is in restraint of trade and serves no useful purpose;
and
WHEREAS,
the State of Georgia may benefit from permitting additional ownership
opportunities of such businesses in this state; and
WHEREAS,
the financial and other implications of an expansion of such licensing and
whether such limitation serves the public good deserve to be fully considered
and studied.
NOW,
THEREFORE, BE IT RESOLVED BY THE SENATE that there is created the Senate Retail
Dealers of Distilled Spirits Study Committee to be composed of six members. The
committee shall be comprised of the Senate President Pro Tempore, the Senate
majority leader, the Senate majority whip, the chairperson of the Senate
Economic Development Committee, and two members of the Senate appointed by the
President of the Senate. The Senate majority whip shall be the chairperson of
the committee. The chairperson shall call all meetings of the
committee.
BE
IT FURTHER RESOLVED that the committee shall undertake a study of the above
issues and recommend any actions or legislation that the committee deems
necessary or appropriate. The committee may conduct such meetings at such
places and at such times as it may deem necessary or convenient to enable it to
exercise fully and effectively its powers, perform its duties, and accomplish
the objectives and purposes of this resolution. The members of the committee
shall receive the allowances authorized for legislative members of interim
legislative committees but shall receive the same for not more than eight days
unless additional days are authorized. The funds necessary to carry out the
provisions of this resolution shall come from the funds appropriated to the
Senate. The committee shall publish a report of its findings and
recommendations which may include suggestions for proposed legislation. Such
report shall be made on or before December 31, 2012. The committee shall stand
abolished on December 31, 2012.
