A BILL FOR AN ACT

 

 

relating to electric vehicles.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


SECTION 1.  The legislature finds that the State's dependence on imported fossil fuels costs billions of dollars each year.  The legislature also finds that ground transportation accounts for approximately one-third of all imported oil consumed in the State.  Accordingly, any increase in the price of imported fuel creates significant burdens on the economy and increases costs to local families.

The legislature notes that alternative vehicles and methods of transportation can help to alleviate the economic and financial burden of fossil fuels.  However, in order for local consumers and families to benefit from alternative vehicles and reduce their reliance on vehicles that use fossil fuels, the State must make significant efforts to establish critical electric vehicle infrastructure, including but not limited to electric vehicle charging stations.  The legislature further finds that other states and municipalities have set standards for new construction to include "electric vehicle ready", or "EV ready", parking stalls, thus ensuring the efficient implementation of electric vehicle charging stations in the future.

The legislature recognizes that the majority of electric vehicle drivers currently use their respective homes as the primary site for charging their vehicles.  Therefore, in order to increase the use of electric vehicles, the legislature believes that the State needs to expand access to electric vehicle charging stations in new state building construction.  Estimates show that electric vehicle infrastructure costs only account for less than one per cent of the total construction costs of a project, while the cost to retrofit existing buildings can cost more than three times this amount.

Furthermore, the legislature notes that because there are currently projects in the process of receiving building permits, it is the intent of the legislature that this Act not affect these projects.

Accordingly, the purpose of this Act is to require that newly constructed state buildings include parking stalls that are pre-wired for electric vehicle charging stations.  For the avoidance of doubt, this Act does not require that the affected parking stalls become dedicated electric vehicle stalls upon becoming "EV ready".

     SECTION 2.  Chapter 103, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

     "§103-    State building construction and reconstruction; requirements.  (a)  All new state building construction and state building reconstruction shall include at least twenty parking stalls within the building's parking structure that are electric vehicle charger ready; provided that the requirements of this subsection shall not apply to the following:

     (1)  Any adjacent existing structure located within the applicable construction site that is not being reconstructed, renovated, retrofitted, or otherwise modified and is not listed on the applicable building permit application;

     (2)  Any renovation or retrofit in which the overall square footage of the structure changes by less than twenty-five per cent or seven thousand five hundred square feet; or

     (2)  Any new state building construction or state building reconstruction for which efforts to obtain a building permit began prior to July 1, 2020.

     (b)  As used in this section:

     "Electric vehicle charger ready" means having sufficient wiring, conduit, electrical panel service capacity, overcurrent protection devices, and suitable termination points to connect to an electric vehicle charger capable of providing a minimum of 208 or 240 volt branch circuit.

     "State building construction" means any building construction project or program initiated by a state agency or requiring the use of state funds.

     "State building reconstruction" means any building reconstruction project or program initiated by a state agency or requiring the use of state funds in which the overall square footage of the building changes by twenty-five per cent or seven thousand five hundred square feet, whichever is less."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2020.
