A BILL FOR AN ACT
RELATING TO ANIMAL cruelty.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1.
The legislature finds that a number of states have enacted various laws
to protect animals from cruel and inhumane treatment, including laws relating
to confinement, sales, slaughter, and consumption. The State of Hawaii recognizes and values the
humane treatment of animals, and as a message to the rest of the nation, joins
the animal-protection states by prohibiting the confinement of specified
animals in a cruel manner and prohibiting the sale of those animals. The legislature further finds that the
federal government prohibits the slaughtering of cats and dogs for human
consumption. Hawaii, like other states,
will conform to the federal prohibition against the slaughter and human consumption
of cats and dogs.
Accordingly, the purpose of this Act is to:
(1) Specify the confinement conditions that avoids
confinement in a cruel manner for certain covered animals and prohibit the sale
of covered animals that are confined in a cruel manner; and
(2) Prohibit the slaughter of dogs and cats for
human conditions.
SECTION 2. Chapter 145, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:
"Part . PROHIBITED
CONFINEMENT AND SALES OF FARM animals
§145-A Definitions. As used in this part:
"Breeding pigs" means any female pig of the porcine species kept for the purpose of commercial breeding that is six months or older or pregnant.
"Business owner or operator" means any person who owns or controls the operation of a business.
"Cage-free housing system" means an indoor or outdoor controlled environment for egg-laying hens within which hens are free to roam unrestricted; are provided enrichment that allow them to exhibit natural behaviors, including, at a minimum, scratch areas, perches, nest boxes, and dust bathing areas; and within which farm employees can provide care while standing within the housing system's usable floorspace. Cage-free housing systems include, to the extent they comply with the requirements of this part, the following:
(1) Multitiered aviaries, in which hens have access to multiple elevated platforms that provide hens with usable floorspace both on top and underneath the platforms;
(2) Partially slatted systems, in which hens have access to elevated flat platforms under which manure drops through the flooring to a pit or litter removal belt below;
(3) Single-level all-litter floor systems bedded with litter, in which hens have limited or no access to elevated flat platforms; and
(4) Any future system that complies with the requirements of this part.
"Calf raised for veal" means any calf of the bovine species kept for the purpose of producing the food product described as veal.
"Confined in a cruel manner" means any one of the following acts:
(1) Confining a covered animal in a manner that prevents the animal from lying down, standing up, fully extending the animal's limbs, or turning around freely;
(2) After December 31, 2019, confining a calf raised for veal with less than forty-three square feet of usable floorspace per calf;
(3) After December 31, 2021, confining a breeding pig with less than twenty-four square feet of usable floor space per pig;
(4) After December 31, 2019, confining an egg-laying hen with less than one hundred forty-four square inches of usable floorspace per hen; and
(5) After December 31, 2021, confining an egg-laying hen with less than the amount of usable floor space per hen required by the 2017 edition of the United Egg Producers' Animal Husbandry Guideline for U.S. Egg-Laying Flocks: Guidelines for Cage-Free Housing or in an enclosure other than a cage-free housing system.
"Covered animals" means any calf raised for veal, breeding pigs, or egg-laying hens that are kept on a farm.
"Egg-laying hen" means any female domesticated chicken, turkey, duck, goose, or guineafowl kept for the purpose of egg production.
"Enclosure" means a structure used to confine a covered animal or animals.
"Farm" means the land, building, support facilities, and other equipment that are wholly or partially used for the commercial production of animals or animal products used for food or fiber; and does not include live animal markets, establishments at which mandatory inspection is provided under the Federal Meat Inspection Act (21 U.S.C. section 601, et seq.), or official plants at which mandatory inspection is maintained under the federal Egg Production Inspection Act (21 U.S.C. section 1031, et seq.).
"Farm owner or operator" means any person who owns or controls the operation of a farm.
"Fully extending the animal's limbs" means fully extending all limbs without touching the side of an enclosure or another animal.
"Liquid eggs" means eggs of an egg-laying hen broken from the shell, intended for human food, with the yolks and whites in their natural proportions, or with the yolks and whites separated, mixed, or mixed and strained. Liquid eggs do not include combination food products, including pancake mixes, cake mixes, cookies, pizzas, cookie dough, ice cream, or similar processed or prepared food products, that are comprised of more than liquid eggs, sugar, salt, water, seasoning, coloring, flavoring, preservatives, stabilizers, and similar food additives.
"Meat" means the part of the muscle of any cattle, sheep, swine, goats, or fallow deer that is skeletal or that is found in the tongue, in the diaphragm, in the heart, or the esophagus, with or without the accompanying and overlying fat, and the portions of bone, skin, sinew, nerve, and blood vessels that normally accompany the muscle tissue and that are not separated from it in the process of dressing. It does not include the muscle found in the lips, snout, or ears.
"Pork meat" means meat of a pig of the porcine species, intended for use as human food.
"Sale" means a commercial sale by a business that sells any item covered by this part, but does not include any sale undertaken at an establishment at which mandatory inspection is provided under the Federal Meat Inspection Act (21 U.S.C. section 601, et seq.), or any sale undertaken at an official plant at which mandatory inspection is maintained under the federal Egg Products Inspection Act (21 U.S.C. section 1031, et seq.). For purposes of this part, a sale shall be deemed to occur at the location where the buyers take physical possession of an item under sections 145-B and 145-C.
"Shell egg" means a whole egg of an egg-laying hen in its shell form, intended for use as human food.
"Turning around freely" means turning in a complete circle without impediments, including a tether, and without touching the side of an enclosure or another animal.
"Uncooked" means requiring cooking prior to human consumption.
"Usable floorspace" means the total square footage provided to each covered animal, as calculated by dividing the total footage of floorspace provided to the animals in an enclosure by the number of animals in that enclosure. In the case of egg-laying hens, usable floorspace shall include both ground space and elevated level flat platforms upon which hens may roost, but shall not include perches or ramps.
"Veal meat" means meat of a calf raised for veal intended for use as human food.
"Whole pork meat" means any uncooked cut of pork, including bacon, ham, chop, ribs, riblet, loin, shank, leg, roast, brisket, steak, sirloin, or cutlet, that is comprised entirely of pork meat, except for seasoning, curing agents, coloring, flavoring, preservatives, and similar meat additives. Whole pork meat does not include combination food products, including soups, sandwiches, pizzas, hotdogs, or similar processed or prepared food products, that are comprised of more than pork meat, seasoning, curing agents, coloring, flavoring, preservatives, and similar meat additives.
"Whole veal meat" means any uncooked cut of veal, including chop, ribs, riblet, loin, shank, leg, roast, brisket, steak, sirloin, or cutlet, that is comprised entirely of veal meat, except for seasoning, curing agents, coloring, flavoring, preservatives, and similar meat additives. Whole veal meat does not include combination food products, including soups, sandwiches, pizzas, hotdogs, or similar processed or prepared food products, that are comprised of more than veal meat, seasoning, curing agents, coloring, flavoring, preservatives, and similar meat additives.
§145-B Prohibited confinement of covered animals. (a) A farm owner or operator within the State shall not knowingly cause any covered animal to be confined in a cruel manner.
(b) Any person who violates this section shall be guilty of a misdemeanor and subject to a fine in an amount not greater than $5,000 for each violation.
§145-C Prohibited sale of covered animals. (a) A business owner or operator shall not knowingly engage in the sale within the State of any of the following:
(1) Whole veal meat that the business owner or operator knows or should know is the meat of a covered animal that was confined in a cruel manner;
(2) Whole pork meat that the business owner or operator knows or should know is the meat of a covered animal that was confined in a cruel manner or is the meat of immediate offspring of a covered animal that was confined in a cruel manner;
(3) Shell egg that the business owner or operator knows or should know is the product of a covered animal that was confined in a cruel manner; and
(4) Liquid eggs that the business owner or operator knows or should know are the product of a covered animal that was confined in a cruel manner.
(b) Any person who violates this section shall be guilty of a misdemeanor and subject to a fine in an amount not greater than $5,000 for each violation."
SECTION 3. Chapter 321, Hawaii Revised Statutes, part XLIV, is amended by adding a new section to be appropriately designated and to read as follows:
"§321- Prohibition
on slaughter of dogs and cats for human consumption. (a) No person shall knowingly:
(1) Slaughter a dog
or cat for human consumption; or
(2) Ship,
transport, move, deliver, receive, possess, purchase, sell, or donate:
(A) A
dog or cat to be slaughtered for human consumption; or
(B) A
dog or cat part for human consumption.
(b) Any person who violates this section shall be guilty of a misdemeanor and subject to a fine in an amount not greater than $5,000 for each violation."
SECTION 4. If any provision of this Act, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the Act that can be given effect without the invalid provision or application, and to this end the provisions of this Act are severable.
SECTION 5. In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.
SECTION 6.
This Act does not affect rights and duties that matured, penalties that
were incurred, and proceedings that were begun before its effective date.
SECTION 7. New statutory material is underscored.
SECTION 8. This Act shall take effect upon its approval; provided that section 1 shall take effect on January 1, 2020.
