A BILL FOR AN ACT

 

 

RELATING TO THE HAWAII HOUSING FINANCE AND DEVELOPMENT CORPORATION BUDGET.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


PART I

     SECTION 1.  The purpose of this Act is to:

     (1)  Establish, appropriate, or authorize additional operating budget amounts for the fiscal biennium beginning July 1, 2019 and ending June 30, 2021 for the Hawaii housing finance and development corporation; and

     (2)  Establish the office of the housing advocate, which shall be funded by the dwelling unit revolving fund.

PART II

     SECTION 2.  DEFINITIONS.  Unless otherwise clear from the context, as used in this part:

     "Expending agency" means the department of business, economic development, and tourism.

     Abbreviations, where used to denote the expending agency or a house of representatives standing committee, shall mean the following:

BED  Department of business, economic development, and tourism

HSG  House of representatives standing committee on housing

     "Means of financing" or "MOF" means the source from which funds are appropriated or authorized to be expended for the programs and projects specified in this part.  All appropriations are followed by letter symbols.  The letter symbols, where used, shall have the following meanings:

W    Revolving funds

     "Program ID" means the unique identifier for the specific program and consists of the abbreviation for the organization responsible for carrying out the program followed by the organization number for the program.

     SECTION 3.  APPROPRIATIONS.  The following sums, or so much thereof as may be sufficient to accomplish the purposes and programs designated herein, are hereby appropriated or authorized, as the case may be, from the means of financing specified to the expending agencies designated for the fiscal biennium beginning July 1, 2019, and ending June 30, 2021.  The total expenditures and the number of positions in each fiscal year of the biennium shall not exceed the sums and the position ceilings indicated for each fiscal year, except as provided elsewhere in this part or as provided by general law.

1.   BED160 - HAWAII HOUSING FINANCE AND DEVELOPMENT CORPORATION

     SECTION 4.  Provided that of the revolving fund appropriations for the Hawaii housing finance and development corporation (BED160):

     (1)  The sum of $228,048 or so much thereof as may be necessary for fiscal year 2019-2020 and the sum of $285,048 or so much thereof as may be necessary for fiscal year 2020-2021 shall be expended to cover payroll and other current expenses in housing administration;

     (2)  The sum of $81,891 or so much thereof as may be necessary for fiscal year 2019-2020 and the same sum or so much thereof as may be necessary for fiscal year 2020-2021 shall be expended to cover increased payroll and other current expenses in housing development; and

     (3)  The sum of $315,350 or so much thereof as may be necessary for fiscal year 2019-2020 and the sum of $323,350 or so much thereof as may be necessary for fiscal year 2020-2021 shall be expended to cover increased payroll and other current expenses in housing finance.

     SECTION 5.  Provided that, with respect to the Hawaii housing finance and development corporation (BED160):

     (1)  Three full-time equivalent (3.0 FTE) permanent positions and four full-time equivalent (4.0 FTE) temporary positions shall be transferred from housing administration to housing development;

     (2)  One full-time equivalent (1.0 FTE) permanent position and one full-time equivalent (1.0 FTE) temporary position shall be transferred from housing development to housing administration; and

     (3)  One full-time equivalent (1.0 FTE) permanent position shall be transferred from housing finance to housing administration;

provided further that the employee shall be transferred without loss of salary, seniority (except as prescribed by applicable collective bargaining agreements), retention points, prior service credit, any vacation and sick leave credits previously earned, and other rights, benefits, and privileges, in accordance with state personnel laws and this part; provided further that the employee possess the minimum qualifications and public employment requirements for the class or position to which transferred or appointed, as applicable; provided further that subsequent changes in status may be made pursuant to applicable civil service and compensation laws.

     Any employee who, prior to this part, is exempt from civil service and is transferred as a consequence of this part may retain the employee's exempt status, but shall not be appointed to a civil service position as a consequence of this part.  An exempt employee who is transferred by this part shall not suffer any loss of prior service credit, vacation or sick leave credits previously earned, or other employee benefits or privileges as a consequence of this part; provided that the employee possesses legal and public employment requirements for the position to which transferred or appointed, as applicable; provided further that subsequent changes in status may be made pursuant to applicable employment and compensation laws.

     SECTION 6.  If any portion of this part or its application to any person, entity, or circumstance is held to be invalid for any reason, then the legislature declares that the remainder of the part and each and every other provision thereof shall not be affected thereby.  If any portion of a specific appropriation is held to be invalid for any reason, the remaining portion shall be expended to fulfill the objective of the appropriation to the extent possible.

     SECTION 7.  If manifest clerical, typographical, or other mechanical errors are found in this part, the governor may correct the errors.

PART III

     SECTION 8.  The Hawaii Revised Statutes is amended by adding a new chapter to be appropriately designated and to read as follows:

"Chapter

housing advocate

     §   ‑1  Office of the housing advocate; qualifications; duties.  (a)  There is established the office of the housing advocate, to be placed within the office of the governor, which shall be headed by the housing advocate and funded by the dwelling unit revolving fund.  The housing advocate shall be appointed, without regard to section 26-34, by the governor to serve a term of four years concurrent with the term of the governor.

     (b)  The housing advocate shall develop, advocate for, and implement policies to solve Hawaii's housing shortage by:

     (1)  Analyzing solutions and programs to address the State's need for housing that is affordable for all economic segments of the State, including but not limited to programs or proposals that provide for:

          (A)  Financing acquisition, rehabilitation, preservation, conversion, or construction of housing;

          (B)  Use of publicly owned land and buildings as sites for affordable housing;

          (C)  Identification of state and local regulatory barriers to the development and placement of housing;

          (D)  Stimulating public and private sector and intergovernmental cooperation in the development of housing;

          (E)  The equitable geographic distribution of housing for all economic segments;

          (F)  Examination of successful housing policies from jurisdictions across the country and the world, and how to adapt them to the State;

          (G)  Addressing the unique circumstances for special needs populations;

          (H)  Provision of infrastructure for existing and future housing needs;

          (I)  Preservation and enhancement of the character of the State's unique cultures and communities;

          (J)  Correction of distortions in the housing market;

          (K)  Prevention of the erosion of housing stock due to speculation, transient accommodations and short-term vacation rentals, and other phenomena; and

          (L)  Addressing the diversity of communities across the State;

     (2)  Considering homeownership and rental housing as viable options for the provision of housing.  The housing advocate shall give consideration to various types of residential construction and innovation housing options, including but not limited to manufactured housing;

     (3)  Reviewing, evaluating, and making recommendations regarding existing and proposed housing programs and initiatives, including but not limited to tax policies, land use policies, and financing programs;

     (4)  Incorporating feedback and concerns from all stakeholders in the State's housing crisis;

     (5)  Attracting and retaining future generations and industries through the provision of abundant and affordable housing; and

     (6)  Engaging and educating the public on housing policies and programs."

     SECTION 9.  Section 201H-191, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  There is created a dwelling unit revolving fund.  The funds appropriated for the purpose of the dwelling unit revolving fund and all moneys received or collected by the corporation for the purpose of the revolving fund shall be deposited in the revolving fund.  The proceeds in the revolving fund shall be used [to]:

     (1)  To reimburse the general fund to pay the interest on general obligation bonds issued for the purposes of the revolving fund[, for];

     (2)  For the necessary expenses in administering housing development programs and regional state infrastructure programs[, and for carrying];

     (3)  To carry out the purposes of housing development programs and regional state infrastructure programs, including but not limited to the expansion of community facilities and regional state infrastructure constructed in conjunction with housing and mixed-use transit-oriented development projects, permanent primary or secondary financing, and supplementing building costs, federal guarantees required for operational losses, and all things required by any federal agency in the construction and receipt of federal funds or lowincome housing tax credits for housing projects[.]; and

     (4)  To fund the office of the housing advocate pursuant to section    -1."

PART IV

     SECTION 10.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 11.  This Act shall take effect on January 1, 2050.

Description:

Appropriates funds for the fiscal biennium 2019-2021 operating budget of the Hawaii Housing Finance and Development Corporation.  Establishes the office of the housing advocate to work with all state agencies that manage land to advocate for solutions to the State's housing shortage, and monitor, comment, and report on the State's production of affordable housing units, the development and implementation of laws, regulations, and policies relating to affordable housing.  Effective 1/1/2050.  (SD1)
