A BILL FOR AN ACT

 

 

RELATING TO EMERGENCY MEDICAL SERVICES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 321, Hawaii Revised Statutes, is amended by adding a new section to part XVIII to be appropriately designated and to read as follows:

     "§321-    Emergency medical services; fees.  (a)  The department may establish reasonable fees to be collected from individuals who are:

     (1)  Transported by emergency ambulance services to any medical facility; or

     (2)  Provided emergency medical services by emergency medical services personnel as part of a community paramedicine program, including evaluations and treatment, but are not subsequently transported to a medical facility.

     (b)  All fees collected pursuant to this section shall be deposited to the credit of the emergency medical services special fund established pursuant to section 321-234.

     (c)  The department may adopt rules pursuant to chapter 91 necessary for the purpose of this section and to set reasonable fees."

     SECTION 2.  Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§346-    Coverage of ambulance services.  Beginning on January 1, 2020, the State's medicaid programs:

     (1)  Shall provide coverage for ambulance services; and

     (2)  May provide coverage for statewide community paramedicine services rendered by emergency medical technicians or paramedics."

     SECTION 3.  Chapter 431, Hawaii Revised Statutes, is amended by adding a new section to part I of article 10A to be appropriately designated and to read as follows:

     "§431:10A-A  Coverage of ambulance services.  Each individual policy of accident and health or sickness insurance issued or renewed in this State on or after January 1, 2020, shall provide coverage for:

     (1)  Ambulance services; and

     (2)  Statewide services rendered by emergency medical technicians or paramedics."

     SECTION 4.  Chapter 431, Hawaii Revised Statutes, is amended by adding a new section to part II of article 10A to be appropriately designated and to read as follows:

     "§431:10A-B  Coverage of ambulance services.  Each group policy of accident and health or sickness insurance issued or renewed in this State on or after January 1, 2020, shall provide coverage for:

     (1)  Ambulance services; and

     (2)  Statewide services rendered by emergency medical technicians or paramedics."

     SECTION 5.  Chapter 432, Hawaii Revised Statutes, is amended by adding a new section to part VI of article 1 to be appropriately designated and to read as follows:

     "§432:1-    Coverage of ambulance services.  Each hospital or medical service plan contract issued or renewed in this State on or after January 1, 2020, shall provide coverage for:

     (1)  Ambulance services; and

     (2)  Statewide community paramedicine services rendered by emergency medical technicians or paramedics."

     SECTION 6.  Section 321-233, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§321-233[]]  Rules.  (a)  The director of health may adopt, amend, and repeal rules necessary to the implementation of this part, subject to chapter 91.

     (b)  Rules adopted pursuant to this section shall include provisions permitting and regulating the transportation of individuals to medical facilities including but not limited to hospital emergency departments, trauma centers, urgent care clinics, freestanding surgical centers, and other medical facilities licensed by the department."

     SECTION 7.  Section 432D-23, Hawaii Revised Statutes, is amended to read as follows:

     "§432D-23  Required provisions and benefits.  Notwithstanding any provision of law to the contrary, each policy, contract, plan, or agreement issued in the State after January 1, 1995, by health maintenance organizations pursuant to this chapter, shall include benefits provided in sections 431:10-212, 431:10A-115, 431:10A-115.5, 431:10A-116, 431:10A‑116.2, 431:10A-116.5, 431:10A-116.6, 431:10A-119, 431:10A-120, 431:10A-121, 431:10A-122, 431:10A-125, 431:10A-126, 431:10A-132, 431:10A-133, 431:10A-134, 431:10A-140, [and 431:10A-134,] and 431:10A-A, and chapter 431M."

     SECTION 8.  Section 23-51, Hawaii Revised Statutes, shall not apply to this Act.

     SECTION 9.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 10.  This Act shall take effect on July 1, 2050.



 

Report Title:

Emergency Ambulance Services; Emergency Medical Services; Fees; Insurance Coverage

 

Description:

Authorizes the department of health to establish fees for transportation to medical facilities and for provision of emergency medical services that do not include transport.  Authorizes transportation by ambulance to medical facilities other than hospital emergency departments.  Requires Medicaid and private insurance coverage of ambulance services.  Authorizes Medicaid programs, and requires private insurers, to provide coverage for statewide community paramedicine services rendered by emergency medical technicians or paramedics.  Effective 7/1/2050.  (SD1)
