A BILL FOR AN ACT

 

 

Relating to THE PRACTICE OF PHARMACY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 461, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows:

     "§461-     Public health and pharmacy formulary advisory committee; duties.  (a)  There is established the public health and pharmacy formulary advisory committee to advise the board of pharmacy on matters relating to a formulary of drugs and devices.  The committee shall consist of seven members to be appointed by the governor pursuant to section 26-34 as follows:

     (1)  Two physicians licensed to practice medicine by the Hawaii medical board;

     (2)  Two advanced practice registered nurses who have prescriptive authority and who are licensed by the state board of nursing; and

     (3)  Three pharmacists licensed by the board of pharmacy, at least one of whom is employed as a community pharmacist and one of whom is employed as a health system pharmacist.

     (b)  The Hawaii medical board, the state board of nursing, and the board of pharmacy may respectively submit to the governor a list of up to three names of individuals to be considered for a vacancy required to be filled by a licensee from that board.

     (c)  Notwithstanding any provision of law to the contrary, the term of each committee member shall be two years.  A member whose term has expired shall continue to serve until a successor is appointed.

     (d)  The committee shall elect one of its members to serve as chairperson.

     (e)  Members of the committee shall serve without compensation and shall not be reimbursed for expenses.

     (f)  A member of the committee who fails to attend two consecutive meetings of the committee shall be removed from the committee unless the failure to attend was due to a serious health condition of the member or a family member of the member.

     (g)  The committee shall recommend to the board of pharmacy, for adoption by rule, a formulary of drugs and devices that a pharmacist may prescribe and dispense to a patient pursuant to a diagnosis by a health care practitioner who is qualified to make the diagnosis.  The committee shall periodically review the formulary and recommend revisions to the board for adoption by rule.

     (h)  The committee may receive requests from a pharmacist to add a drug or device to the formulary on a request form to be prescribed by the board of pharmacy.

     (i)  The committee may consider a concept for the development of a protocol submitted by a pharmacist on a form to be prescribed by the board of pharmacy.

     §461-     Prescriptive authority of pharmacists.  (a)  The board may issue certificates of special competency in the prescription and administration of vaccines to a licensed pharmacist who has completed training accredited by the Centers for Disease Control and Prevention, the American Council on Pharmaceutical Education, or a similar health authority or professional body.

     (b)  The board may adopt rules:

     (1)  Allowing a pharmacist to prescribe vaccines, provide patient care services, and submit protocol concepts to the public health and pharmacy formulary advisory committee;

     (2)  Establishing a formulary of drugs and devices, as recommended by the public health and pharmacy formulary advisory committee, that a pharmacist may prescribe and dispense to a patent pursuant to a diagnosis by a health care practitioner who has prescriptive authority and who is qualified to make the diagnosis; provided that the formulary may include post-diagnostic drugs and devices such as diabetic testing supplies, emergency refills of insulin, albuterol inhalers, epinephrine autoinjectors, smoking cessation aids, discharge medications for transitions of care, rapid strep tests, and spacers;

     (3)  Requiring pharmacists to establish protocols for the prescription and administration of vaccines and the provision of patient care services; and

     (4)  Requiring the reporting of the prescription and administration of vaccines to a patient's primary health care provider and to the Hawaii health authority."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2020.

Report Title:

Pharmacists; Prescriptive Authority; Advisory Committee

 

Description:

Establishes the public health and pharmacy formulary advisory committee to advise the Board of Pharmacy in developing a formulary of drugs and devices that a pharmacist may prescribe and dispense.  Authorizes the Board of Pharmacy to allow pharmacists to prescribe vaccines as well as drugs and devices from the formulary developed with the assistance of the advisory committee.
