A BILL FOR AN ACT

 

 

RELATING TO PLANNED COMMUNITY ASSOCIATIONS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 421J, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§421J-     Accessory dwelling units; restrictions, prohibited.  No association may restrict a member from constructing an accessory dwelling unit on property that is subject to the authority of the association and that is under the separate ownership or occupancy of the member."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2025.

Description:

Prohibits a planned community association from prohibiting a member from constructing an accessory dwelling unit that is under the separate ownership or occupancy of the member.  Takes effect on 7/1/2025.  (HD1)
