A BILL FOR AN ACT

 

 

RELATING TO HEALTH.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to subpart C of part IV to be appropriately designated and to read as follows:

     "§302A-     Confiscation of electronic smoking devices and electronic smoking device products.  (a)  A teacher or educator at a public school may confiscate an electronic smoking device or electronic smoking device product that is found in the possession of a student who is under the age of twenty-one.

     (b)  Each public school shall coordinate with the applicable county police department for the proper disposal of electronic smoking devices or electronic smoking device products confiscated pursuant to subsection (a) within three months of the confiscation.

     (c)  No teacher or educator, nor the public school that employs the teacher or educator, who acts or fails to act in accordance with this section shall be liable in any court of law for acting or failing to act in accordance with this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2050, and shall be repealed on January 1, 2023.

Description:

Authorizes public school teachers and educators to confiscate electronic smoking devices and electronic smoking device products.  Requires public schools to coordinate with the appropriate county police departments for the proper disposal of confiscated electronic smoking devices and electronic smoking device products within three months of confiscation.  Repeals on 1/1/2023.  Takes effect on 7/1/2050.  (HD1)
