A BILL FOR AN ACT

 

 

RELATING TO FOwL.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


SECTION 1.  The legislature finds that feral chickens and roosters have established themselves in communities throughout the State.  They have become a nuisance, particularly in many suburban and urban communities, by trespassing into yards and gardens, digging up plants, damaging food crops, and jeopardizing native plants.  The increasing number of feral chickens and roosters also create a road hazard for drivers who must suddenly stop or swerve to avoid them.

     The legislature further finds that unsanitary droppings from these birds are a health concern.  Feral chickens carry diseases that threaten or kill native Hawaiian birds.  There is fear that feral chickens will spread disease to domestic fowl and to other wild birds.  Feral roosters crow at all times of the day and night, which has led to numerous concerns and complaints in locations throughout the State about their noise.

     The purpose of this Act is to reduce the feral chicken and rooster population in the State by appropriating funds to the department of health to purchase traps for feral chickens and roosters and to rent the traps at a nominal fee to residents.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2019-2020 and the sum of $         or so much thereof as may be necessary for fiscal year 2020-2021 for the department of health to purchase traps for feral chickens and roosters and to rent the traps at a nominal fee to residents; provided that:

(1)  The department of health may contract with eligible non-profit entities or for-profit entities to carry out the purposes of this Act; and

(2)  No funds shall be made available to purchase and rent traps to residents of a county unless that county provides matching funds on a one-to-one basis for the purpose of purchasing traps for feral chickens and roosters.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2019.
