A BILL FOR AN ACT
RELATING TO TRANSPORTATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to part IV to be appropriately designated and to read as follows:
"§291C- Flood
zone; depth gauge signs. (a) The department of transportation or
appropriate county agency shall post a depth gauge sign on any portion of a public
highway that:
(1) Is under its
jurisdiction;
(2) Lies
within a special flood hazard area; and
(3) Is prone to
flooding.
(b) The depth gauge sign shall be posted in a
manner consistent with the manual on uniform traffic control devices.
(c) As used in this section:
"Depth gauge sign" means
a depth gauge sign as defined by the manual on uniform traffic control devices.
"Manual on uniform traffic control
devices" means the most current edition of the manual on uniform traffic
control devices, as amended, published by the Federal Highway Administration.
"Public highway" shall
have the same meaning as in section 264-1.
"Special flood hazard area" means an area identified as a special flood hazard area by the Federal Emergency Management Agency."
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2019-2020 and the same sum or so much thereof as may be necessary for fiscal year 2020-2021 for posting of depth gauge signs on public highways pursuant to this Act.
The sums appropriated shall be expended by the department of transportation for the purposes of this Act.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2050.
