A BILL FOR AN ACT

 

 

relating to animals.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 150A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§150A-     Dangerous wild animals; prohibition on importation.  (a)  No person shall import a dangerous wild animal into the State except as provided in this section.

     (b)  The board may authorize, by permit, the import of a dangerous wild animal for:

     (1)  A research, medical, or scientific purpose approved by the board; or

     (2)  Exhibition in a government zoo or government-affiliated aquarium.

     (c)  The chairperson may authorize, by permit, the import of a dangerous wild animal for a period not to exceed ninety days for performance in commercial filming; provided that:

     (1)  The dangerous wild animal's performance is part of the scene within a production being filmed; and

     (2)  The permit includes conditions sufficient to address any associated risks and to assure the applicability of this subsection.

     (d)  As used in this section, "dangerous wild animal" means a non-domestic animal capable of causing significant risk to animal or public health and safety in the absence of containment measures and safeguards, including the following animals:

     (1)  Lion (Panthera leo);

     (2)  Tiger (Panthera tigris);

     (3)  Cheetah (Acinonyx jubatus);

     (4)  Jaguar (Panthera onca);

     (5)  Cougar (Felis concolor);

     (6)  Leopard (Panthera pardus);

     (7)  Clouded leopard (Panthera nebulosa);

     (8)  Caracal (Felis caracal or Lynx caracal);

     (9)  Ocelot (Felis pardalis);

    (10)  Margay (Felis wiedii);

    (11)  Serval (Felis serval);

    (12)  Bear (all species in the family Ursidae);

    (13)  Wolf (Canis lupus and Canis rufus);

    (14)  Hyena (Crocuta crocuta);

    (15)  Aardwolf (Proteles cristatus);

    (16)  Elephant (all species in the family Elephantidae);

    (17)  Rhinoceros (all species in the family Rhinocerotidae);

    (18)  Hippopotamus (all species in the family Hippopotamidae);

    (19)  Non-human primates (all species in order Primates except humans);

    (20)  Crocodile (all species in genus Crocodylus);

    (21)  Alligator (Alligator mississippiensis);

    (22)  Caiman (Caiman crocodilus);

    (23)  Gharial or gavial (Gavialis gangeticus); and

    (24)  Any other animal determined by the board to be a dangerous wild animal."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
