A BILL FOR AN ACT

 

 

RELATING TO FERAL BIRDS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 712, Hawaii Revised Statutes, is amended by adding a new section to part V to be appropriately designated and to read as follows:

     "§712-    Feeding of wild or feral birds; penalty.  (1)  A person commits the offense of feeding a wild or feral bird if the person knowingly feeds a wild or feral bird.

     (2)  A person who commits the offense of feeding a wild or feral bird shall be guilty:

     (a)  For a first offense, of a violation.

     (b)  For a second and subsequent offense, of a petty misdemeanor.

     (3)  This section shall not apply to:

     (a)  Any animal control officer, duly incorporated humane society, or duly authorized governmental agency feeding wild or feral birds OvoControl or any other avian reproductive control product in accordance with accepted animal control practices and any state or federal law; or

    (b)   Employees or authorized agents of county, state, or federal agencies who are carrying out activities required under a management plan approved by county, state, or federal agencies pursuant to a mandatory statutory duty for the protection of species listed as threatened or endangered species and other wildlife species protected by law.

     (4)  As used in this section:

     "Wild or feral bird" means any non-domesticated avian, including pigeons; provided that "wild or feral bird" shall not include chickens."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
