A BILL FOR AN ACT
RELATING TO CAMPAIGN FINANCE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 11, Hawaii Revised Statutes, is amended by adding a new section to part XIII, subpart E, to be appropriately designated and to read as follows:
"§11- Independent
expenditure contributions; disclosure; requirements. (a)
If an independent expenditure advocates the election or the defeat of a
clearly identified candidate, the noncandidate committee or other person making
the expenditure shall identify the candidate that the noncandidate committee or
other person is supporting or opposing in any report or statement required by
sections 11-335 or 11-341; provided that if an independent expenditure
advocates the election or defeat of multiple candidates, the noncandidate or
other person shall list all candidates supported or opposed. If an independent expenditure advocates in
support of or in opposition to a question on the ballot other than the election
of a candidate, the noncandidate committee or other person shall indicate that
the expenditure is for issue advertising only.
(b) The commission shall publish independent expenditure information for each candidate on its website, including:
(1) The amount of
each independent expenditure advocating the election or the defeat of the
candidate; and
(2) The
noncandidate committee or other person making the expenditure.
(c) Noncandidate committees or other persons making false statements in any disclosure required by this section shall be subject to penalties pursuant to subpart I."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. If any provision of this Act, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the Act that can be given effect without the invalid provision or application, and to this end the provisions of this Act are severable.
SECTION 4. New statutory material is underscored.
SECTION 5. This Act shall take effect on January 28, 2081.

Requires noncandidate committees and other persons who make independent expenditures supporting or opposing a candidate to report expenditures in support or opposition. Requires the Campaign Spending Commission to post independent expenditure information for each candidate on the Commission's website. Effective 1/28/2081. (SD1)
