A BILL FOR AN ACT

 

 

PROPOSING AN AMENDMENT TO ARTICLE II OF THE CONSTITUTION OF THE STATE OF HAWAII.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to propose an amendment to article II of the Constitution of the State of Hawaii to allow a recount of votes cast at an election to be conducted, as provided by law.

     SECTION 2.  Article II of the Constitution of the State of Hawaii is amended by adding a new section to be appropriately designated and to read as follows:

"RECOUNT OF ELECTION VOTES

     Section   .  A recount of votes cast at an election may be conducted as provided by the legislature."

     SECTION 3.  The question to be printed on the ballot shall be as follows:

     "Shall the Hawaii State Constitution be amended to allow the Legislature to enact laws that provide for the manner of conducting a recount of votes cast at an election?"

     SECTION 4.  New constitutional material is underscored.

     SECTION 5.  This amendment shall take effect on January 28, 2081 and upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
