A BILL FOR AN ACT

 

 

RELATING TO CONSUMER PROTECTION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 489J, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§489J-    Electronic proof of purchase.  (a)  Each proof of purchase for the retail sale of tangible personal property or for the provision of services in this State to a member of a frequent shopper program may be provided in electronic form.

     (b)  A retailer that offers electronic proof of purchase to a member pursuant to this section shall develop, implement, and maintain reasonable safeguards to protect the security, confidentiality, and integrity of a member's personal information, including disposal of the data.

     (c)  As used in this section:

     "Frequent shopper program" means a program that rewards customers for purchases made on multiple visits and builds up points entitling customers to reduced prices, free items, or other incentives.

     "Member" means a member of a frequent shopper program."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2019.

Description:
