A BILL FOR AN ACT

 

 

RELATING TO THE HAWAII STATE PLANNING ACT.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to establish the Hawaii State Planning Act review commission to update the Hawaii State Planning Act by amending and refocusing the goals, objectives, and policies of the State to reflect current cultural, economic, and societal goals.

     SECTION 2.  Chapter 226, Hawaii Revised Statutes, is amended by adding three new sections to part II to be appropriately numbered and to read as follows:

     "§226-A  Establishment of the Hawaii State Planning Act review commission.  (a)  There shall be a Hawaii State Planning Act review commission, hereinafter called the commission.  The commission shall consist of nine members, of which seven shall be appointed by the governor with the advice and consent of the senate, one member who shall be a member of the senate and shall be appointed by the president of the senate, and one member who shall be a member of the house of representatives and shall be appointed by the speaker of the house of representatives.

     (b)  The commission members appointed by the governor shall include persons with expertise in economics, small and large business administration, Hawaiian culture, environmental protection, tourism, and military affairs.

     (c)  The commission shall be attached to the office of planning for administrative purposes.  The commission shall elect its chairperson from among its members.  Commission members shall receive no compensation for their services, but shall be reimbursed for actual expenses incurred in the performance of their duties.

     (d)  The commission may enter into contracts with consultants and engage employees necessary to perform its duties, without regard to chapter 76.  Departments of the state government shall make available to the commission data and facilities as are necessary for it to perform its duties.

     §226-B  Term of Hawaii State Planning Act review commission members.  A commission shall be appointed on or before July 1, 2020, and a new commission shall be appointed on or before July 1 every five years thereafter; provided that if any vacancy occurs in the membership of a commission prior to the completion of its duties or dissolution, the appointing authority specified in section 226-A shall appoint a replacement member.  The commission shall meet from time to time as necessary to execute its duties.  Each commission shall dissolve upon the adjournment sine die of the legislature to which it submits the evaluation and recommendations required by section 226-C.

     §226-C  Duties of the Hawaii State Planning Act review commission.  Using the information and data provided by the office of planning pursuant to section 226-53, each commission shall conduct a systematic review of this chapter.  Thirty days prior to the convening of the second regular session of the legislature after the members of the commission have been appointed, the commission shall submit to the legislature an evaluation of this chapter and recommend policy additions, amendments, or deletions."

     SECTION 3.  Section 226-7, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  Planning for the State's economy with regard to agriculture shall be directed towards achievement of the following objectives:

    [(1)  Viability of Hawaii's sugar and pineapple industries.

     (2)] (1)  Growth and development of diversified agriculture throughout the State.

    [(3)] (2)  An agriculture industry that continues to constitute a dynamic and essential component of Hawaii's strategic, economic, and social well-being."

     SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2019-2020 and the same sum or so much thereof as may be necessary for fiscal year 2020-2021 to carry out the purposes of this Act.

     The sums appropriated shall be expended by the office of planning for the purposes of this Act.

     SECTION 5.  In codifying the new sections added by section 2 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.

     SECTION 6.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 7.  This Act shall take effect on July 1, 2050; provided that section 4 shall take effect on July 1, 2050.
