HOUSE CONCURRENT

RESOLUTION

 

 

Requesting the Department of Land and Natural resources to establish the Manoa Valley Flood Mitigation Task Force to research and make recommendations on flood mitigation for Manoa valley.

 

 

 


     WHEREAS, on October 30, 2004, heavy thundershowers flooded Manoa Stream, catching trees, cars, and debris; and

 

WHEREAS, a rain gauge at Lyon Arboretum in Manoa Valley report 8.36 inches of rain in six hours; and

 

     WHEREAS, the Manoa Stream overflowed, causing water to spill into the valley, flooding the neighborhood, Noelani Elementary School, and the University of Hawaii at Manoa; and

 

     WHEREAS, the flood damaged forty University of Hawaii buildings, causing an estimated $100,000,000 in damages to the buildings themselves, the buildings' contents, and intellectual property housed there; and

 

     WHEREAS, following the flood, the United States Army Corps of Engineers analyzed Manoa Stream and found that the streambed had insufficient capacity to contain the flood waters; and

 

     WHEREAS, the Department of Land and Natural Resources has been developing a project to remove the sediment of Manoa Stream for the purpose of increasing the stream's capacity to contain flood waters; and

 

     WHEREAS, after conducing community outreach for the proposed project, the Department of Land and Natural Resources has temporarily paused construction on the project in light of concerns expressed by Manoa residents now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Thirtieth Legislature of the State of Hawaii, Regular Session of 2019, the Senate concurring, that the Department of Land and Natural Resources is requested to establish a Manoa Valley Flood Mitigation Task Force; and

 

BE IT FURTHER RESOLVED that the task force is requested to research and make recommendations on flood mitigation for Manoa Valley; and

 

     BE IT FURTHER RESOLVED that the Chairperson of the Board of Land and Natural Resources or the Chairperson's designee is requested to serve as the chair of the task force; and

 

     BE IT FURTHER RESOLVED that the task force is requested to include:

 

     (1)  The Director of Transportation, or the Director's designee;

 

     (2)  The Comptroller, or the Comptroller's designee;

 

     (3)  The Chancellor of the University of Hawaii at Manoa, or the Chancellor's designee;

 

     (4)  The Chief Engineer of the City and County of Honolulu, or the Chief Engineer's designee;

 

     (5)  The Director of Transportation Services of the City and County of Honolulu, or the Director's designee;

 

     (6)  The Director of Planning and Permitting of the City and County of Honolulu, or the Director's designee;

 

     (7)  The Manager and Chief Engineer of the Board of Water Supply of the City and County of Honolulu, or the Manager and Chief Engineer's designee;

 

     (8)  A member of the Senate whose district includes at least a portion of Manoa, who shall be appointed by the Senate President;

 

     (9)  A member of the House of Representatives whose district includes at least a portion of Manoa, who shall be appointed by the Speaker of the House of Representatives; and

 

    (10)  A member of the Honolulu City Council whose district includes at least a portion of Manoa, who shall be appointed by the Chair of the Honolulu City Council; and

 

     BE IT FURTHER RESOLVED that the Chairperson of the Board of Land and Natural Resources is requested to invite the following individuals to become members of the task force:

 

     (1)  A representative from the United States Army Corps of Engineers;

 

     (2)  A representative from the Flood Mitigation Assistance Grant Program of the Federal Emergency Management Agency; and

 

     (3)  Any other individual whose membership, in the opinion of the Chairperson, would provide a benefit to the task force; and

 

     BE IT FURTHER RESOLVED that the task force members shall serve without compensation but shall be reimbursed for travel and other necessary expenses incurred in the performance of their official duties; and

 

     BE IT FURTHER RESOLVED that members of the task force who are public officers or employees shall receive no additional compensation for service on the task force beyond their normal compensation; and

 

     BE IT FURTHER RESOLVED that no member of the task force shall be made subject to chapter 84, Hawaii Revised Statutes, solely because of that member's participation on the task force; and

 

     BE IT FURTHER RESOLVED that the Department of Land and Natural Resources is requested to provide administrative support to the task force; and

 

     BE IT FURTHER RESOLVED that task force is requested to submit a report of its findings and recommendations, including any proposed legislation, to the Legislature and the Honolulu City Council no later than twenty days prior to the convening of the 2020 Regular Session of the Legislature; and

 

     BE IT FURTHER RESOLVED that the task force shall cease to exist on June 30, 2020; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to Federal Emergency Management Agency Region 9 Regional Administrator, United States Army Corps of Engineers District Commander of the Honolulu District, Chairperson of the Board of Land and Natural Resources, Director of Transportation, Comptroller, Chancellor of the University of Hawaii at Manoa, Speaker of the House of Representatives, President of the Senate, Chief Engineer of the City and County of Honolulu, Director of Transportation Services of the City and County of Honolulu, Director of Planning and Permitting of the City and County of Honolulu, Manager and Chief Engineer of the Board of Water Supply of the City and County of Honolulu, and Chair of the Honolulu City Council.
