HOUSE CONCURRENT

RESOLUTION

 

 

REQUESTING A SUNRISE ANALYSIS OF THE REGULATION OF dental assistants.

 

 

 


     WHEREAS, dental assistants are a currently unregulated profession in Hawaii; and

 

     WHEREAS, H.B. No. 374, H.D. 1 (2017), introduced during the Regular Session of 2017, proposes to regulate the practice of dental assistants by establishing regulatory controls that may affect dental assistants; and

 

     WHEREAS, H.B. No. 374, H.D. 1 (2017), does not propose to require dental assistants to be registered, certified, or licensed, but instead merely proposes to prohibit the Board of Dental Examiners from adopting rules under which the duties of dental assistants will infringe upon, or overlap or conflict with, the duties of dental hygienists; and

 

     WHEREAS, other states require dental assistants to be either registered or licensed; and

 

     WHEREAS, section 26H-6, Hawaii Revised Statutes (HRS), requires certain regulatory measures to be referred to the Auditor for analysis if the regulatory measure being considered for enactment would subject unregulated professions and vocations to licensing or other regulatory controls upon enactment; and

 

     WHEREAS, section 26H-6, HRS, further requires that referral to the Auditor shall be by concurrent resolution that identifies a specific legislative bill to be analyzed and that the analysis shall:

 

(1)  Set forth the probably effects of the proposed regulatory measure;

 

(2)  Assess whether the enactment of the proposed regulatory measure is consistent with the legislative policies of the Hawaii Regulatory Licensing Reform Act, chapter 26H, HRS; and

 

(3)  Assess alternative forms of regulation;

 

now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-ninth Legislature of the State of Hawaii, Regular Session of 2017, the Senate concurring, that in accordance with section 26H-6, Hawaii Revised Statutes, the Auditor is requested to conduct a sunrise analysis of H.B. No. 374 H.D. 1, introduced during the Regular Session of 2017, relating to certain regulatory controls that may affect dental assistants; and

 

     BE IT FURTHER RESOLVED that the Auditor is requested to submit findings and recommendations, including any proposed legislation, to the Legislature not less than twenty days prior to the convening of the Regular Session of 2018; and

 

     BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Auditor.
