HOUSE RESOLUTION

 

 

REQUESTING THE hawaii development disabilities council TO Convene A WORKING GROUP to coordinate all services provided to individuals with intellectual and developmental disabilities and their families.

 

 


     WHEREAS, the State has a responsibility to provide support and services for individuals with intellectual and developmental disabilities, so that these individuals may live self-determined lives; and

 

     WHEREAS, several State departments are responsible for various support and services to individuals with intellectual and developmental disabilities; and

 

     WHEREAS, lack of coordination among the services and planning activities of the various State departments results in gaps in the spectrum of needed services, duplication of services, lack of clarity in responsibility for services, and poorly articulated inter-agency programs, thereby reducing the quality of programs for individuals with intellectual and developmental disabilities; and

 

     WHEREAS, because of specific mandates of the departments, it is essential that a body responsible for coordinating services and planning for individuals with intellectual and developmental disabilities be established outside the departments responsible for support and services; and

 

     WHEREAS, community participation is a major goal of the State, thus state and county agencies should adopt policies and regulations that will support individuals with intellectual and developmental disabilities and their families to fully participate in their communities; and

 

     WHEREAS, family support is another major goal of the State when providing families of children with disabilities the support services necessary to support the family, including enabling families of children with disabilities to nurture and enjoy their children at home; enabling families of children with disabilities to make informed choices and decisions regarding the nature of support, resources, services, and other assistance made available to the families; and supporting family caregivers of adults with disabilities; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Thirtieth Legislature of the State of Hawaii, Regular Session of 2019, that the Hawaii Developmental Disabilities Council is requested to convene a working group to coordinate all services provided to individuals with intellectual and developmental disabilities and their families; and

 

     BE IT FURTHER RESOLVED that the working group is requested to coordinate the services of the following:

 

     (1)  Developmental Disabilities Division of the Department of Health;

 

     (2)  Division of Vocational Rehabilitation of the Department of Human Services;

 

     (3)  Med-QUEST Division of the Department of Human Services;

 

     (4)  Disability Compensation Division of the Department of Labor and Industrial Relations;

 

     (5)  Workforce Development Division of the Department of Labor and Industrial Relations; and

 

     (6)  Workforce Development Council; and

 

     BE IT FURTHER RESOLVED the Hawaii Developmental Disabilities Council is requested to provide advice and recommendations to the impacted divisions and council on how to improve provision of services and the application process to individuals with intellectual and developmental disabilities and their families, including but not limited to:

 

     (1)  Tests and procedures used to determine eligibility;

 

     (2)  Timelines related to any notifications connected to eligibility determinations;

 

     (3)  Content of service plans for eligible individuals;

 

     (4)  Budgets;

 

     (5)  The appeals process;

 

     (6)  Training for any individuals working in or affected by services supporting individuals with intellectual and developmental disabilities; and

 

     (7)  Any other areas that would or could contribute to a more consumer-responsive system of service and support; and

 

     BE IT FURTHER RESOLVED that the impacted divisions and council are requested to report to the working group on these factors, including quantified data, if applicable, no later than October 1, 2020; and

 

     BE IT FURTHER RESOLVED that the working group is requested to submit a report to the Legislature of its findings and recommendations, including any proposed legislation, no later than twenty days prior to the convening of the Regular Session of 2021; and

 

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Director of Health; Director of Human Services; Director of Labor and Industrial Relations; Administrator of the Developmental Disabilities Division, Department of Health; Administrator of the Division of Vocational Rehabilitation, Department of Human Services; Administrator of the Med-QUEST Division, Department of Human Services; Administrator of the Disability Compensation Division, Department of Labor and Industrial Relations; Administrator of


the Workforce Development Division, Department of Labor and Industrial Relations; and Executive Director of the Workforce Development Council.
