A BILL FOR AN ACT

 

 

relating to smoking.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 302A-102, Hawaii Revised Statutes, is amended to read as follows:

     "§302A-102  Smoking prohibited.  (a)  All public schools within the State, from kindergarten through grade twelve, shall prohibit the use of tobacco at public schools or at public school functions.

     (b)  Any person under the age of twenty-one who violates subsection (a) shall be fined $100.  In the case of a person under the age of eighteen, the fine may be levied against the person's parent or legal guardian.  The fine levied pursuant to this section shall be in addition to any other applicable fines or penalties.  The department shall adopt rules pursuant to chapter 91 to implement this subsection.

     (c)  The fine specified in this section shall not be suspended or waived."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2019.
