A BILL FOR AN ACT

 

 

Relating to ballots.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 11-116, Hawaii Revised Statutes, is amended to read as follows:

     "§11-116  Checking ballot form and layout by the public, candidates, and parties.  (a)  As soon as is reasonably practicable after the close of filing and after a ballot is initially formatted pursuant to this part, the chief election officer and the county clerk shall allow public input on the facsimile ballot prior to its finalization and its printing.  Electronic copies of facsimile ballots shall be accessible for review on the office of elections website.  The facsimile ballots shall show the typefaces used, the spelling and placement of names, and other information on the ballot.  Each facsimile ballot posted on the office of elections website shall allow the public to submit comments on the facsimile ballot via electronic means.

     (b)  [Facsimiles] After the public comment period described in subsection (a), facsimiles of all ballot layouts prior to printing shall be available for viewing by the candidates and the parties at the office of the chief election officer and the county clerk [as soon after the close of filing as they are available.  Such layout facsimiles shall show the typefaces used, the spelling and placement of names, and other information on the ballot].

     (c)  The chief election officer or the county clerk, as applicable, may revise the layout and form of the ballot in response to comments received pursuant to subsections (a) and (b) from the public, candidates, and parties."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
