A BILL FOR AN ACT
relating to FAST CHARGE electric vehicle CHARGING SYSTEMS.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that Honolulu is among the top ten electric vehicle markets in the United States. Hawaiian Electric Company estimates that three thousand six hundred public chargers will be needed by 2030 to fulfill the electric vehicle demand across all islands of the State, in addition to the private chargers needed at homes and businesses. Most electric vehicles are currently capable of driving approximately one hundred miles before needing a recharge, which, depending on battery size and available voltage, can take several hours. For residents with longer commutes and those in more remote regions, direct current fast chargers can help eliminate "range anxiety", as they can add sixty to one hundred miles of range in just twenty minutes of charging.
Accordingly, the purpose of this Act is to require the department of transportation to install two hundred fast charge electric vehicle charging systems statewide by December 31, 2021, and an additional one thousand fast charge electric vehicle charging systems by December 31, 2025. The distribution of the installed fast charge electric vehicle charging stations between the counties shall be based upon the number of electric vehicles in each county.
SECTION 2. (a) The department of transportation shall install two hundred fast charge electric vehicle charging systems by December 31, 2021, and an additional one thousand fast charge electric vehicle charging systems by December 31, 2025; provided that the fast charge electric vehicle charging systems shall be installed in places of public accommodation or private parking facilities or sites; and provided further that the fast charge electric vehicle charging systems shall be installed throughout the State proportionate to the number of registered electric vehicles in each county.
(b) For the purposes of this Act:
"Electric vehicle" means:
(1) A neighborhood electric vehicle as defined in section 286-2, Hawaii Revised Statutes;
(2) A vehicle, with four or more wheels, that draws propulsion energy from a battery with at least four kilowatt hours of energy storage capacity that can be recharged from an external source of electricity; or
(3) A fuel cell electric vehicle.
"Electric vehicle charging system" means a system that:
(1) Is capable of providing electricity from a non-vehicle source to charge the batteries of one or more electric vehicles;
(2) Meets recognized standards, including standard SAE J1772 of SAE International; and
(3) Is designed and installed in compliance with article 625 of the National Electrical Code;
provided that the term shall not include facilities or systems for refueling the hydrogen storage tank of a fuel cell electric vehicle.
"Fast charge electric vehicle charging system" means an electric vehicle charging system with a power output capability between twenty and one hundred kilowatts.
"Fuel cell electric vehicle" means a zero-emission electric vehicle that uses a fuel cell to convert hydrogen gas and oxygen into electricity that is used in a vehicle powertrain for propulsion.
"Place of public accommodation" has the same
meaning as that provided in section 489-2, Hawaii Revised Statutes.
"Private parking" means:
(1) A
privately-owned parking facility or site where invitation to the general public
is express or implied; and
(2) Is
accessible twenty-four hours per day every day of the week.
SECTION 3. This Act shall take effect upon its approval.
