A BILL FOR AN ACT
relating to housing.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 201H, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§201H- Advertising
housing subject to certain occupancy requirements as rentals prohibited. (a)
Any person who advertises, for rental purposes, any housing subject to
an owner or renter occupancy requirement under this chapter shall be guilty of
a misdemeanor; provided that nothing in this section shall prohibit any state
agency from advertising or publicizing a housing program covered by this
chapter.
(b) This section shall be enforced by the police
department of the county in which the housing is located."
SECTION 2. Chapter 206E, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§206E- Advertising housing subject to certain
occupancy requirements as rentals prohibited. (a)
Any person who advertises, for rental purposes, any housing subject to
an owner or renter occupancy requirement under this chapter shall be guilty of
a misdemeanor; provided that nothing in this section shall prohibit any state
agency from advertising or publicizing a housing program covered by this
chapter.
(b) This section shall be enforced by the police
department of the county in which the housing is located."
SECTION 3. Chapter 356D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§356D- Advertising
rental of public housing unit prohibited. (a)
Any person who advertises a public housing unit for rental purposes shall
be guilty of a misdemeanor; provided that nothing in this section shall
prohibit any state agency from advertising or publicizing rental of public
housing subject to this chapter.
(b) This section shall be enforced by the police department of the county in which the public housing unit is located."
SECTION 4. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 5. New statutory material is underscored.
SECTION 6. This Act shall take effect upon its approval.
