A BILL FOR AN ACT

 

 

RELATING TO NOISE CONTROL.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that section 11-46-1, Hawaii Administrative Rules, states, "It is the purpose of this chapter to define the maximum permissible sound levels, and to provide for the prevention, control, and abatement of noise pollution in the State from the following excessive noise sources: stationary noise sources; and equipment related to agricultural, construction, and industrial activities.  It is also the purpose of this chapter to establish noise quality standards to protect public health and welfare, and to prevent the significant degradation of the environment and quality of life."  The legislature recognizes that the department of health has the responsibility to address excessive noise issues and the impacts of excessive noise in the State.

     The purpose of this Act is to require the department of health, in collaboration with the Federal Aviation Administration and the department of transportation, to conduct a study on the impacts of aviation noise on residents of the State.

     SECTION 2.  (a)  Pursuant to section 11-46-1, Hawaii Administrative Rules, the department of health, in collaboration with the Federal Aviation Administration and the department of transportation, shall conduct a study to determine the impacts of aviation noise on the health and welfare of residents of the State.  Public meetings shall be held during the course of the study to obtain the community's input on the aviation noise issue.

     (b)  The department of health, in collaboration with the Federal Aviation Administration and the department of transportation, shall report its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2020.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $100,000 or so much thereof as may be necessary for fiscal year 2019-2020 to conduct a study to determine the impacts of aviation noise on the health and welfare of residents of the State.

     The sum appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2019.
